  • USA - Australia Free Trade Agreement & Intellectual Property
    Recently, the subject of a large amount of press in Australia and only a small amount in the US, was the signing of the Free Trade Agreement between the US and Australia. As usual with FTAs, intellectual property plays an important role. Whilst not much has been written on effects of the FTA between Australia and the US, the USPTO has released a media release on this.

    "Increasingly, both the U.S. and our trading partners are relying on intellectual property-based industries to drive economic growth. In fact, about 50 percent of U.S. exports now depend on some form of intellectual property (IP) protection. The negotiation of free trade agreements with our trading partners is an essential way for strengthening protection of American IP assets abroad. Free trade agreements allow nations to import and export products and goods with the goal of reducing or eliminating tariffs and other trade barriers.

    The United States and Australia concluded a free trade agreement (FTA) on February 8, 2004. The FTA negotiations, led by the United States Trade Representative (USTR), resulted in a comprehensive IP chapter that will enhance the already strong relationship between the U.S. and Australia in the areas of patents, trademarks, copyrights and enforcement. Some highlights from the agreement include protections ensuring parity and transparency between trademarks and geographical indications, increased term protection for copyright works to life of the author plus 70 years, patent office/regulatory authority linkage and notification for pharmaceutical products when a third party applies for marketing approval during the term of a patent, and effective procedures and penalties for counterfeit trademark and copyright goods.

    The USPTO (attorneys from the Offices of International Relations and Enforcement) plays a critical role in the FTA process by providing continuing technical support to USTR in all aspects of the negotiations, including the drafting of the IP provisions. The objective of our FTAs in the IP arena is to build on the foundations established in existing international agreements in the field of IP, especially the 1994 Trade Related Aspects of Intellectual Property (TRIPs) Agreement. While the TRIPs agreement sets a minimum standard for IP by which all World Trade Organization member countries must abide, these FTAs reflect elevated emerging global IP standards".

  • GetIPDL - New Version 2.10.9 Released
    GetIPDL have released another update to their Patent Downloading software.   This version fixes some issues with
    - Downloading B documents before CN85101851B from SIPO was supported.
    - Sending patent numbers from CIPO search result was supported.
    - SmartTag on Microsoft Office 2003 was supported. (avoid Microsoft Office 2003 bug.)
    - Set temporary folder hidden.
    - Accessibility was improved.There is no canceling during multiple patents downloading.

  • Hong Kong - More Information on Design Search System
    The Hong Kong registered design records will be available for online search on 16 February 2004 (today). The new online system contains all registered designs on the Hong Kong Register of Designs. The Intellectual Property Department ran workshops to help practitioners and the public understand and maximize the use of the new system on 6 February 2004.   • STN - New Databases in 2004
    Chemical Abstracts Service (CAS) and CSA have agreed to add eight CSA databases to the STN International online network during 2004. Subject areas represented by the CSA databases soon to join STN are biotechnology, engineering specialties, earth and environmental studies and library and information science.   • Dialog Enhances BIOSIS Previews® Database Available Through Dialog® and Dialog DataStar™ Services
    BIOSIS Previews, one of the BIOSIS databases available through the Dialog and Dialog DataStar services, contains citations from Biological Abstracts® (BA), and Biological Abstracts/Reports, Reviews, and Meetings® (BA/RRM) (formerly BioResearch Index®).

    The most significant enhancements to the BIOSIS Previews database available through the Dialog and Dialog DataStar services include:

    - the addition of CAS® Registry Numbers to more than nine million BIOSIS Previews records;
    - the addition of more than 6,300 sequence data accession numbers; and
    - the addition of BIOSIS Major Concepts, an indexing field that enables researchers to identify and retrieve targeted information by conceptual terms, now added to every citation back to 1969.

    Other improvements to BIOSIS Previews include additional revisions to indexing fields, such as newly added taxonomical terms, revised biosystematic codes and revised mapping of Medical Subject Heading (MeSH®) Disease terms. In addition, the bibliographic data has been standardized and the patent indexing feature streamlined.

  • WIPO Make Changes to IP Information Presentation
    WIPO announced on 5 February 2004 that their
    The Standards and Documentation Working Group (SDWG) of the Standing Committee on Information Technologies (SCIT), adopted a revision of WIPO Standard (ST.10/C) regarding the bibliographic data components of patent documents.

    "Companies, inventors, academics and users of the intellectual property system will benefit from a decision last week by member states of the World Intellectual Property Organization (WIPO) to revise certain standards associated with the recording, storage, exchange and retrieval of patent, trademark and industrial design information. These standards facilitate access to and use of the rich pool of publicly available industrial property information associated with the grant of patents, trademarks and industrial designs. This will also make it easier to access prior art information, which is critical in determining the patentability of an invention.

    The Standards and Documentation Working Group (SDWG) of the Standing Committee on Information Technologies (SCIT), adopted a revision of WIPO Standard (ST.10/C) regarding the bibliographic data components of patent documents, in particular the presentation of priority application numbers. Priority application numbers are attributed to applicants by industrial property offices. This number establishes priority over any rival applications from that date and also marks the beginning of the period of validity of the patent itself. The priority application number appears in the notification of the first filing, and in the certificates of priority under the Paris Convention for the Protection of Industrial Property.

    Priority application numbers are cited by applicants when filing a subsequent application for the same or related subject matter with another industrial property office in accordance with the Paris Convention. The priority application number can then be used by industrial property offices to link all related patent document "families" together in databases and computerized search systems. The ability to create patent families is of tremendous value to users of the industrial property system as they enable patent examiners to review previously published patent documents in a given language, if available. Patent families facilitate the patent classification process by allowing industrial property offices to use the classifications of one patent family member for all members of the patent family. These and other uses of patent families make the accurate recording of the priority application number by applicants a critical concern of all industrial property offices".

  • Singapore - Online SCOPE IP Goes Live!
    A new service from Intellectual Property Office of Singapore (IPOS) called SCOPE IP has just been released.

    "SCOPE IP helps to assess companies' ability to manage the risk associated with their IP and to identify and categorise the IP they own. In so doing, companies are better able to leverage on their IP for maximum shareholder value. This objective assessment of companies' IP capabilities can also form a basis or starting point to facilitate business negotiations.

    Phase I of the SCOPE IP comprises 2 modules, namely The Strategic Management Module and The Portofolio Management Module. The Strategic Management Module was launched in September 2003. IPOS has now launched The Portfolio Management Module.

    This module allows companies to identify their own IP portfolio and examine if they have a proper system in place to manage their stock of IP. It focuses on the common forms of IP namely, Patents, Trade Marks, Copyright, Industrial Designs and Confidential Information.

    Companies can simply log on to www.surfip.gov.sg and sign up as a member at no cost and attempt the online IP questions. Upon completion, scores will be computed and analysis on the company's IP management practices as well as recommended improvements will be provided on the spot".

    This month the Estonian Patent Office launched a database of industrial designs. The database contains information on industrial designs registered and on industrial design registration applications filed in the Republic of Estonia since 11 January 1998.   • IPI-ConfEx - International Patent Information Conference & Exposition
    Trudi Jones from IPI-Confex has sent me some update information on the IPI-Confex conference (International Patent Information Conference & Exposition) that is taking place in Europe in early March 2004. This is brand new conference and it is specifically focused to address the issues of most importance to patent information professionals. IPI-ConfEx will be of interest to information managers, searching professionals, and all those working in connection with patents in a professional setting such as patent department personnel, patent information and library staff, patent law practitioners, and vendors of patent information services, etc. Trudi tells me that Registration is filling quickly, so if you intend on attending I recommend that you get your registration form in as soon as possible.     A few facts about IPI-Confex
    The conference with be conducted in English and will take place takes place on 7-10 March 2004 in Lisbon, Portugal, with satellite workshop events (hosted by Thomson Scientific, MicroPatent, Chemical Abstract Service/STN, Minesoft, Questel-Orbit and Thomson Dialog) being offered on 7th and 11th March.

    IPI-ConfEx is being organised as a direct result of a need expressed by many patent specialists for such a meeting to be held in Europe. It is being steered by a Board of Counselors, representing the different Patent Information User Association that are well known for their active participation in matters of importance to the patent information community. Working as part of the Board in helping to coordinate the conference are Lucy Akers and Ford Khorsandian, who together form the backbone of the organisational team. Both already have extensive experience in organising conferences in North America and in Europe; Akers through her role as Chairman of the Patent Information Users Group (PIUG) in the US, and Khorsandian in his former roles as Vice-Chairman of PIUG, International Marketing Director with Chemical Abstracts Service and Vice-President of Derwent Inc.

    The emphasis of the meeting is a strong conference programme that is targeted to the issues facing patent information specialists. The program features presentations from a number of the patent information industry's most respected and knowledgeable professionals, including: Dr. Ursula Schoch-Gruebler, Senior Vice-President of the BASF Group Information Center in Germany, who is the 2003 recipient of the International Patent Information Award; Gerard Giroud and Nigel Clarke from the European Patent Office; and many other notable patent information experts from the world's leading research based corporations.

    Also featured are talks and workshops from major vendors, who will be presenting patent information solutions and discussing these from the perspective of information users. An exhibition hall will give attendees plenty of opportunity to ask questions and benefit from hands-on demonstrations of the latest products and services.

  • UK - Patents Bill Published
    The new UK Patents Bill was published 16 January 2004. According the the UK Patent Office the Bill proposals "would provide a more supportive framework, particularly for small businesses, to enforce patent rights and ensure that UK patent law continues to underpin and promote innovation".

    The Patents Bill would:

    - enable the Patent Office to provide an independent non-binding opinion on patent validity or infringement to settle disputes over patent rights without parties having to resort to expensive litigation;

    - bring UK patent law into line with the revised European Patent Convention to reduce bureaucracy and make it simpler for UK businesses to operate across Europe;

    - modernise UK patent law to be more responsive to customers needs by for example, allowing the Patent Office to make amendments to application forms without amending regulations; and

    - modify existing protection for alleged infringers to encourage out-of-court settlement of disputes whilst still deterring patent owners from making unreasonable allegations of infringement.

  • New Edition of Locarno Classification
    On 1 January 2004, the 8th edition of the International Classification for Industrial Designs (Locarno Classification) entered into force. The OHIM applies this new edition of the Locarno Classification as from the 1st January 2004 for all the applications for registered Community designs (RCD) filed on or after that date. Pending RCD applications or already registered Community designs having a filing date prior to 1st January 2004 will not be reclassified and there will be no option for their reclassification available to the RCD applicant or proprietor.

    The major changes introduced:
    - introduction of two separate subclasses for seats (subclass 6-01) and for beds (subclass 6-02) and reclassification of the products of the previous common subclass 6-01;
    - introduction of one new subclass for Screen displays and icons (subclass 14-04);
    - reclassification of certain products, introduction of new products and amendments in the wording of one subclass title and of some products.

  • US - Jon Dudas Takes Helm at United States Patent and Trademark Office
    Jon W. DudasIt is reported today that Jon Dudas has become the Acting Under Secretary of Commerce for Intellectual Property and Acting Director of the U.S. Patent and Trademark Office (USPTO).

    Background to Jon Dudas: "As a private practitioner in the early 1990s, Dudas had a significant intellectual property practice that included extensive trademark and copyright work. During his six years as Counsel to the Subcommittee on Courts and Intellectual Property, and Staff Director and Deputy General Counsel for the House Committee on the Judiciary--the birthplace of all federal intellectual property statutory law--he guided enactment of major patent, trademark and copyright policy, including the most sweeping revisions to American patent law since 1952, the 1999 American Inventors Protection Act, and the passage of the Digital Millennium Copyright Act, the 1998 law implementing two landmark international treaties protecting creative works in the digital age. Dudas was also instrumental in the passage of the 1996 Trademark Anti-Counterfeiting Consumer Protection Act, a law making it more difficult for seized counterfeit merchandise to re-enter the consumer marketplace........."     Just announced is the news that the Thomson Corporation has acquired the publishing assets of Biological Abstracts, Inc. and BIOSIS including the world's "largest life sciences abstracting and indexing service".

  • IPI-Confex Update
    The organisers of the IPI-Confex meeting to be held in in Lisbon from 7-11 March 2004 have just announced two new speakers, both from the EPO.

    Gerard Giroud, Principal Director in the Hague, and Dr. Nigel Clarke, from the EPO Promotion Department in Vienna.
    Dr. Clarke's talk is entitled: Is there a Mass Market for Patent Information? How could such a Market be satisfied?

  • USPTO - Outages
    The USPTO is reporting some downtime for some of their web based services.

    (1) The USPTO.GOV website will be inaccessible between 10 PM and 10:30 PM EST on Sunday, January 11 due to local utility work.

    (2) The USPTO.GOV website and electronic business systems will be unavailable for periods between 12 Noon EST on Sunday, January 18 and 12 Noon EST on Monday, January 19 due to scheduled system maintenance. Please do not attempt to connect to the sites or process any transactions through our electronic business systems at any time during the entire outage period as we cannot guarantee site resources or completion of online activities during the scheduled outage period.

  • Questel-Orbit Enhanced Patent Delivery Service
    Questel-Orbit have just announced their "newly enhanced" Patent Delivery Service or PDS. The enhancement takes the form of becoming a web-based service at www.patentdelivery.com

    PDS allows access to patent copies from over 30 countries and international patent offices, as well as copies of different publication stages, from applications to grants. New options let you either directly open and save the copies or e-mail them to yourself and other parties. The new Portfolio enhancement lets you keep track of ordered and delivered patents over the last 30 days, and maintain them for five days. Track by customer with built-in sub-account option.

    There are two payment options for the new PDS:
    (a) Annual subscription: from 1,900 euros/USD for one user to 11,000 euros/USD for corporate access allows for unlimited patent delivery through PDS.
    (b) Pay-as-you-go: Price reduced to 3.00 euros/USD per patent copy
    Questel-Orbit customers can access PDS with your existing user id.

    Ken Koubek from PIUG is reminding people that PIUG memberships are now due. Are you a member of the PIUG?
