  • News From esp@cenet
    A new version of esp@cenet preview has been released featuring some general improvements and fixes. It extends the maximum number of answers to 500 for normal searches and updates the family look-up feature.


    It should be noted that the term "family" has several different meanings depending on what service you uses. The esp@cenet website has an excellent description of the various types including the definition used on the esp@cenet website.

  • Delphion - Time Tracking Facility Now Available
    Delphion has introduced a new feature for corporate/group subscribers (both Unlimited and Premier). "Time Tracking" allows you to track the amount of time you spend on the Delphion website against a specific client reference. You are able to track against one client reference, stop, and then track against another client reference. There are summary reports that let you see how much time was tracked against each client reference.

  • First PCT Application File Fully Electronically at WIPO
    We have been monitoring the PCT-SAFE project for some time and now WIPO can report that the first fully electronic application has been filed.

    "Dutch electronics giant Philips (Koninklijke Philips Electronics N.V.) became the first this week to file a fully electronic international application under the World Intellectual Property Organization’s (WIPO) Patent Cooperation Treaty (PCT) with WIPO as receiving office using PCT-SAFE ("Secure Applications Filed Electronically") software. The availability of this upgraded secure electronic filing facility within the WIPO receiving office means that PCT users can now file their international applications either on-line or using physical media such as CD-R. This heralds a new era in the operations of the PCT, the cornerstone treaty of the international patent system. The availability of secure electronic filing will translate into significant efficiency gains both for users of the system and for WIPO which administers the PCT".

    "The PCT-SAFE software, which is expected to be available to all users of the PCT by the end of 2003, offers PCT applicants significant benefits. Users will be able to submit validated applications without the printing, copying and mailing normally associated with such a transaction. PCT-SAFE will also allow users to receive almost immediate notification that their application has been received and is being processed. The PCT-SAFE development was made possible through the adoption by the industrial property offices of the PCT contracting states of a legal framework and technical standard necessary for the implementation of electronic filing and processing of international applications, and its subsequent promulgation".

  • WIPO - Intellectual Property Laws and Treaties
    Intellectual Property Laws and Treaties and Lois et traités de propriété intellectuelle are the oldest periodicals of the World Intellectual Property Organization (WIPO), and represent an important source of documentation on intellectual property legislation, recent and past. Their publication (under different names) dates back to 1885 for industrial property legislation and to 1888 for copyright and related rights legislation. The latest 3/2003 edition is now available here.

  • Swiss E-Trademarks Booming
    News from the Swiss Office indicates that after only seven months online, more than 50% of the total number of trade mark applications submitted to the Institute of Intellectual Property for trademark registration in May were submitted electronically via the official website e-trademark.ige.ch. I understand that e-applications are on the rise in several other countries.

    The European Patent Office is moving ahead with their rebuild and redesign of esp@cenet with the launch of the "esp@cenet information centre" and the new "esp@cenet forum".

    - The "esp@cenet information centre" is available at the new domain http://www.espacenet.com. "At this site, you will find plenty of links to information about esp@cenet, to searching tips and how to interpret results. Of course you will also find links not only to the existing service, but also to a working preview of the new interface that will replace it soon".

    2) The new "esp@cenet forum" is available at http://forum.espacenet.com. "This follows a series of announcements by EPO staff and in EPIDOS News over the past few months. The esp@cenet forum's purpose is to provide a platform for users to exchange views and ask questions not only of the EPO experts, but also other experienced esp@cenet users".

  • Australia - Intellectual Property Laws Amendment Act 2003 & Patents Amendment Regulations 2003 (No. 2)
    The amendments to the Patents Act and Regulations relating to the Intellectual Property Laws Amendment Act 2003 & Patents Amendment Regulations 2003 (No. 2) come into effect on 26 August 2003. IP Australia has posted a summary of the effect of these amendments on their website (reproduced below):

    1. Disclosure of search results – s.45(3) and 101D

    The requirements of s.45(3) and 101D for disclosing search results have been completely replaced. The new scheme has replaced the old scheme in its entirety – there is no ongoing requirement to meet obligations under the old scheme that do not exist under the new scheme.

    The new requirements for applications for standard patents are:

    Only results of searches conducted by a foreign patent office are required to be disclosed
    The results can be provided either as a list, or as a copy of the search report
    Search results from the EPO or the UK Patent office must include the categorisation symbol applied by that office
    The results must be provided by the latest of:
    6 months after the search was completed
    6 months after requesting examination
    1 February 2004 (a transitional date)
    The time for filing the search results can be extended from the above date to a date up to 3 months after the date of publication of the notice of acceptance – merely by making a request on an approved form, and paying a fee. If the application for the extension (together with the search results) is filed on or before the date acceptance is advertised, the fee is $100/month. If it is filed after advertisement of acceptance, the fee is $150/month (for the whole period of the extension). An indicative 'approved form' for seeking this extension will be mounted on the IPAustralia website in the near future.
    IMPORTANT NOTE: The responsibility for seeking the correct length of extension lies with the applicant, as generally the Commissioner will have no direct knowledge of when the search was completed, and therefore of the date the results were due to be filed.

    Extensions of time under s.223 are available
    There are a range of search results that are not required to be disclosed:
    A search that produces a nil result
    An International Search Report, or an additional search done during International Preliminary Examination
    For divisional applications - search results disclosed in relation to the parent or grandparent application (but not other members of divisional families)
    For Additional applications, search results disclosed in relation to the parent
    Search results that were not received by the applicant
    Search results (other than those of the EPO or UK Patent Office) that have previously been given to the Commissioner in respect of the application, or are contained in an International Search Report.
    No regulations are presently prescribed for the purpose of s.45(3)(b)
    The regime for Innovation Patents is similar except that:

    The time for providing the search results is unchanged from previously. That is, the latest of:
    when the patentee requests examination
    If another person requests examination, when the patentee pays their component of the examination fee
    3 months from the Commissioner informing the patentee that the Commissioner is going to examine the patent
    3 months after the search is completed.
    The time for filing the search results can only be extended under s.223
    For divisional applications, the exemption from filing search results that have been filed in respect of other members of the divisional family, only extends to the immediate parent
    2. PCT applications in the national phase – Art. 34 amendments

    Where a PCT application enters the national phase, s.89(5) of the Patents Act ensures that various amendments made in the International phase are treated as part of the Australian specification.

    Under s.89(5), the incorporation of amendments made under Art. 34 of the PCT is conditioned on the Demand having been filed within the time limit specified under Art. 39 of the PCT. While the time limit under Art. 20 was recently changed from 19 months to 30 months, the time limit under Art. 39 remains as 19 months.

    While in the past Demands were almost always filed before the end of the 19th month, this will not be the case in the future, particularly having regard to the PCT Rule changes that come into effect on 1 January 2004. To allow for this, new regulation 8.1B provides that where a Demand is filed after the 19th month, Art. 34 amendments form part of the Australian specification provided the International Preliminary Examination Report has been established before national phase entry occurs.

  • USA - United States Joins the Madrid Protocol
    The United States completed the formal process for joining the Madrid Protocol on 2 August 2003 when it deposited the accession document with the World Intellectual Property Organization (WIPO). The United States Patent and Trademark Office (USPTO) will begin accepting Madrid filings on November 2, 2003.

    IP Menu has added a new page to the IP Menu Resources group. IP Blog Resources. Blogger.com define a blog as "a web page made up of usually short, frequently updated posts that are arranged chronologically—like a what's new page or a journal. The content and purposes of blogs varies greatly—from links and commentary about other web sites, to news about a company/person/idea, to diaries, photos, poetry, mini-essays, project updates, even fiction. Blog posts are like instant messages to the web".

  • Australia - An NPS Problem Resolved
    As previously reported, when searching Innovation Patent records, the NPS online searching database (Patsearch) was displaying incorrect date information in the "Certified Date" field if the patent also displayed a "Certified Advertised Date".

    IP Australia are now reporting that this problem has been resolved.

  • New Zealand - Trade Marks Regulations Finally Appear - Or Do They?
    The Intellectual Property Office of New Zealand (IPONZ) has advised that the Trade Marks Regulations 2003 (SR 2003/187) were Gazetted yesterday (7 August 2003). The Trade Marks Act 2002 is due to come into force on 20 August 2003 and until yesterday there were no corresponding Regulations available. Unfortunately, the Regulations are still unavailable!

    Calls to Legislation Direct in New Zealand have indicated that they will not be available until next week, and even then it may be difficult to get a copy.

    Practitioners in New Zealand and Australia are going to have very little time to study the new Regulations in time for the commencement of the most major shake up in New Zealand Trade Mark law in years.  It is surprising that IPONZ has not taken the initiative and posted a copy of the new Trade Mark Regulations on their website.....but perhaps they have not even seen them yet!!!!!

  • BW - Botswana Accedes to WIPO's Patent Cooperation Treaty
    Botswana has become the 122nd Contracting State of the Patent Cooperation Treaty (PCT).  The Treaty will enter into force for Botswana on October 30, 2003.

    Botswana's accession means that as from October 30, 2003, nationals and residents of Botswana may file PCT applications. Also, as from that date, it will be possible to file international applications designating Botswana (country code: BW), and because Botswana will be bound by Chapter II of the PCT, it will be possible to elect that State for the purposes of international preliminary examination.

  • WIPO - USA Accession to Madrid System
    The accession by the United States of America to the Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks will enter into force in respect of the US on 2 November 2003.

    "The Madrid system gives a trademark owner the possibility to have his mark protected in several countries by simply filing one application, in one language, with one set of fees in one currency (Swiss francs). An international registration produces the same effects as an application for registration of the mark made in each of the countries designated by the applicant. If protection is not refused by the trademark office of a designated country, the protection of the mark is the same as if it had been registered by that office. The system provides a cost-effective and efficient way for trademark holders to ensure protection for their marks in multiple countries through the filing of a single application.

    The Madrid system is governed by two treaties: the Madrid Agreement, dating from 1891 and revised several times since then, and the Madrid Protocol, which came into operation in 1996, introducing some new features into the system to address difficulties that had impeded adherence by certain countries. A country may adhere to either the Agreement or to the Protocol or to both".

  • USPTO - New Members to Patent & Trademark Public Advisory Committees
    The USPTO's Commerce Secretary Don Evans has appointed three new members each to the Patent Public Advisory Committee and the Trademark Public Advisory Committee. The boards advise the Under Secretary of Commerce for Intellectual Property and Director of the USPTO on the management of patent and trademark operations.

    The new members of the Patent Public Advisory Committee are:

    Rick D. Nydegger, a Salt Lake City, Utah attorney.
    Andrew Dillon of Austin, Texas, a partner of Bracewell and Patterson, L.L.P.

  • Questel-Orbit - New Database - NPL
    Questel-Orbit has announced the release of NPL, a new companion file to PlusPat and scitech files on Questel-Orbit.

    The NPL file is the internal EPO examiner file containing non-patent literature (bibliographic) cited references found in the Search Reports of EP published applications. These are the XP citations found in PlusPat, not only EP, but also PCT and FR Search Reports (the Citation or CT field).

    NPL on Questel-Orbit includes:
    * EPO examiner non-patent literature cited references
    * References from both the EPO internal collection as well as external sources.

  • New Zealand - Trade Marks Act 2002 - Fee Structure
    The Intellectual Property Office of New Zealand has advised that due to the implementation of the Trade Marks Act 2002, several changes to the trade mark fee structure will occur. While the new fees have not yet been confirmed, IPONZ has advised the intended nature of the changes in relation to both application and renewal fees.

    Application Fees

    Application fees will effectively remain at their current level. The new Act allows for applications to be made in more than one class however, the application fee will be charged for each class.

    Renewal of Registration

    Under the new Act all trade marks will have a renewable 10 -year term of registration. To ensure that this change in the term of registration does not result in a significant financial burden to clients, the fee for the renewal of a trade mark registration will be reduced, to reflect the reduction in the term of registration from 14 to 10 years.

    The Australia Law Reform Commission (ALRC) has just released a new Issues Paper entitled "Intellectual Property Rights over Genetic Materials and Genetic and Related Technologies". The terms of reference forming the basis of this Issues Paper include:

    (a) the impact of current patenting laws and practices—including licensing—related to genes and genetic and related technologies on:

    (i) the conduct of research and its subsequent application and commercialisation;

    (ii) the Australian biotechnology sector; and

    (iii) the cost-effective provision of healthcare in Australia;

    (b) what changes, if any, may be required to address any problems identified in current laws and practices, with the aim of encouraging the creation and use of intellectual property to further the health and economic benefits of genetic research and genetic and related technologies; and

    (c) any other relevant matter.

    The CIPO have recently introduced improvements to the Trademarks Database including:

    - Quick search functionality has been improved by adding additional search/reset buttons at the top of the page.
    - Searches can now be performed with or without the Vienna Classification.
    - Search engine can now process text which contains a dot (e.g. "chapters.ca" is searchable).

  • UK - New Policy Chief at UK Patent Office
    The UK Patent Office has just announced that Peter Lawrence is to be the new Director of Intellectual Property and Innovation (IPI) at the Patent Office. Peter has been at the Patent Office since 1997 as Head of the Trade Marks and Designs Directorate.

    "Peter will be in charge of a team of over fifty staff, working on a broad range of policy issues. The main responsibilities of the recently created IPI Directorate include:

    - Driving forward of the objectives of the DTI's Innovation Review, whose thrust is to nurture innovation in the UK economy, including the development of robust, useable and affordable intellectual property strategies;

    - Working on national, European and international intellectual property policy on such topics as the Community Patent, Copyright Directives, international trade marks systems, TRIPs and the Patent Law Treaty;

    - Bringing about better intellectual property enforcement, through training for enforcers, accessible dispute resolution, and raising public awareness of the destructive nature of IP crime (e.g. counterfeiting and piracy);

    - Raising awareness of the importance of intellectual property for UK businesses and academia through seminars, workshops, teaching aids and the internet; and

    - Maintaining a customer focussed London Office for the receipt of applications and the provision of public search facilities, conference rooms and court rooms.

  • Australia - Intellectual Property Laws Amendment Bill 2002
    IP Australia has posted a notice regarding the recently passed Intellectual Property Laws Amendment Bill 2002.

    The Intellectual Property Laws Amendment Bill 2002 was passed by Parliament on 19 June 2003 and is now awaiting Royal Assent.

    This Bill amends the extension of time provisions in the Patents, Trade Marks and Designs Acts. Under the amended Acts, where a time period is not complied with because of an error or omission by a third party, such as a contractor performing services for the Patent, Trade Marks or Designs Office, the time period can be extended.

    The Bill also replaces the current regime for the disclosure of search results under sections 45 and 101D of the Patents Act. The new search results regime will require applicants and patentees to disclose the results of searches conducted by other Patent Offices in respect of corresponding applications filed overseas.

    The new regime will apply to all standard patents that had not been accepted before 1 April 2002 and to all innovation patents unless the Commissioner of Patents had commenced examination of the patent before 1 April 2002. This is the same as the application arrangement that was put in place for the current disclosure regime, which commenced on 1 April 2002. As such, any requirement to comply with the current regime will be replaced with a requirement to comply with the new regime once it commences. To prevent any duplication, the Bill specifically provides that any information disclosed under the current regime will be taken to have been filed under the new regime and does not need to be re-submitted.

    IP Australia is now finalising the amendments to the Patents Regulations that are needed to implement the details of the new disclosure regime. It is intended that the Regulations will allow applicants and patentees sufficient time to prepare for compliance with the new regime before compliance becomes mandatory.

    The amendments to sections 45 and 101D of the Patents Act commence 2 months after Royal Assent, which usually occurs 7 to 10 days after passage of a Bill. Accordingly, these amendments should commence by the end of August.

    IP Australia have announced that they, in association with around 25 Australian universities, will be presenting intellectual property seminars specifically targeted at the university community.

    Each seminar will cover topics such as:

    - How to protect your research before publishing,
    - The process for protecting patents, trade marks and designs,
    - IP management - options for capitalising on IP,
    - Key considerations in the university environment,
    - Case studies based on the experience of other researchers, and
    - Where to go for advice and information.

  • GetIPDL - New Version 2.5.14 Now Available
    getipdl-1.jpg (12607 bytes)GetIPDL have released another update to their Patent Downloading software.   Version 2.x is a Shareware program, however there is a freeware versions with certain limitations.    These limiations are removed when you register the product.  The cost is US$89.00 to get the registered version. It should be noted that the tracking or statistic feature which concerned many users is now removed in the licenced version. 
    In this update the changes include:
    - Downloading full text and images from WIPO was supported.
    - Old Finnish patents (before FI100000) are supported.

  • UK - Changes to section 16 and Grant Publication Processes (A & B Documents)
    The UK Patent Office has initiated some changes in response to the requests to publishing both "A" and "B" documents on esp@cenet on the day of publication. For this to occur changes to the UK Patent Office’s publication procedures were made on 7 July 2003.

    "From 7 July 2003 the publication process will be changed and it will no longer be possible to withdraw patent applications on or after the PPC (preparations for publication) date to prevent section 16 publication date even in exceptional circumstances. Also from this date it will not be possible to prevent granted patents being published after the grant letter has been issued".

  • Australia - NPS Database Update
    IP Australia has published a list of all records affected by the recent "acceptance" and "certification" date problems. The list of records is in Excel spreadsheet form and is available here. "The changed date spreadsheet file .... contains a list of records affected by the Patent Search Advice notice posted on 17 June 2003...These records were displaying the incorrect Accepted, Certified, Sealed, Lapsed or Ceased date when viewed via the online NPS search database (Patsearch)"
    .
    It is still very important that users of NPS read all the notices posted on the IP Australia website before conducting searches of the NPS database.

  • WIPO - Member States Update Patent Information Retrieval Systems
    "Member States of the World Intellectual Property Organization (WIPO) attending a meeting of the Working Group on the International Patent Classification (IPC) in Geneva from June 4 to 13, 2003, agreed to incorporate additional classifications for traditional knowledge based inventions and business methods patents into an international system designed to facilitate search and retrieval of patent information in all fields of technology. The IPC is a hierarchical classification system covering all fields of technology which is indispensable for efficient retrieval of patent information. This system is periodically revised to take account of technological developments and to ensure a more user-friendly and accessible patent classification and search tool, for specialists and non-specialists alike. The current (seventh) edition of the IPC entered into force on January 1, 2000. The next edition to be published in June 2004 will enter in force from January 1, 2005 and will reflect many changes in actively evolving fields of technology".
