  • IPI-ConfEx 2005 Call for Papers - Deadline 15 September 2004

    "We are pleased to announce the call for papers for IPI-ConfEx 2005 – Best Practices in Patent Information Management and Searching. This is the European meeting designed to give patent information users the opportunity to share their searching and information management knowledge and experience. The conference will take place near Malaga, Spain from March 6-10, 2005.

    We are particularly interested to hear from information users within corporations, patent offices, law firms, or universities who are able to discuss one of the following topics:

    - Recent developments in the use of patents for technology value assessment
    - Practical challenges facing the patent analyst
    - Data exchange between different analysis tools
    - Comparison of new tools for claims analysis
    - Techniques for validity searches
    - Techniques for clearance searches

    A new services for US and other Patent Specifications is now available, Pat2PDF. "Pat2PDF.com is a service that makes dealing with patent documents easier. It started as a service to convert the native U.S. patent documents into industry standard PDF documents. Since that time, it's grown to meet all your patent viewing and searching needs".

  • Questel-Orbit & Lingway
    Questel-Orbit has just announced that the acquisition of 12.5% of Lingway’s capital. Lingway which is a Paris based company, "specializes in the design, development and implementation of linguistic-based software solutions. Specifically, Lingway’s technology consists of a natural language search engine, categorization of coding tools, software for generating an XML structure from textual documents, as well as information extraction and document visualization functions".     According to the Press Release, Questel•Orbit and Lingway have working together over the last year on a new product called "PatReader" which is a "tool to improve full-text patent reading efficiency".

  • US - PatentIn 3.3 Released
    The United States Patent and Trademark Office has just released version 3.3 of PatentIn. The new features in this version include:

    - Easier Sequence Skipping – A checkbox has been added to the sequence window to indicate whether a sequence should be skipped. The sequence will be skipped if the box is checked and all data related to the skipped sequence can remain in the PatentIn 3.3 project during the sequence listing generation.

    - Sequence Type Conversion – PatentIn 3.3 allows sequence type conversion between non-protein type sequences by clicking on the new AlterSeqType button on the sequence window.

    - Direct access from the main window to the database window instead of the journal window is provided in PatentIn 3.3. The system also provides direct access from any publication window to any other publication windows.

    - More date validations – For example: all dates entered into the sequence listing must be earlier than the current date; the Current Filing Date must be more recent than the Prior Application Filing Date; and, the Publication Date must be more recent than the Filing Date.

  • UK Patent Office - Short Guide to Trade Marks
    The UK Patent Office, Institute of Trade Mark Attorneys and the Chartered Institute of Patent Agents have joined forces to produce a "Short Guide to Trade Marks".

    "Businesses primarily register trade marks to protect their company name and their products. Trade marks also help you to build a distinctive identity and reputation for your company and any products that you manufacture:

    Trade marks can be words, logos, colours, shapes, or sounds.

    You register your trade mark in one or more classes of services or goods at the Patent Office. To apply to register a trade mark in one category (class) of goods or services costs £200, each additional class costs £50.

    The trade mark must not describe your product or service directly.

    The trade mark must not mislead people about the nature of your goods or services.

    The trade mark must not conflict with one already registered by someone else.

    Your trade mark should not be easily mistaken for another company’s in the same field. Even if the other company has not registered their name or product, it can still take action on the grounds of "passing off".

    You first register your trade mark for ten years, though it can be renewed indefinitely for further ten-year terms.

    You can bring actions against anyone who appears to be using your registered trade mark without your permission.

    Beware, as it is not enough just to register your trade mark, you have to use it as well to make your protection valid or another party can request that your trade mark is revoked.   • Chemical Abstracts - 7,000+ Records back to 1900 Added
    Chemical Abstracts has just announced that it has expanded its "Scientific Century" project by making thousands of additional early 20th century articles from American Chemical Society (ACS) journals and others available online. Planned for release in September, the enhanced content will enable researchers to access more than 7,000 additional records back to 1900, including publications even older than the beginning of Chemical Abstracts (CA).

  • Australia - Designs Old Act and New Act
    IP Australia is advising users that the DesAdmin database has been amended so records will now indicate "1906 Act" and "Amended 1906 Act" instead of "Old Act" and "New Act". Of course it is important to not that designs logded under the 2003 Designs Act ARE NOT on the DesAdmin (Design Mainframe Database). For that information you need to search the ADDS system.

    One of the most impressive IP related websites around is by Rolf Claessen. It is called IPNewsFlash and it is a portal for the latest Patent and IP News, Notices and Decisions. It is an exceptionally good site and worth a regular visit. Rolf has provided immense functionality with his site including tools like this running news bar.



    Also check out his implementation of the Open Patent Services from the EPO. He has implemented this service using PHP, XSL and Open Patent Services. An impressive achievement.

  • Australia - Labor Introduces US/AU Free Trade Agreement Amendments
    Mark Latham - Leader of Opposition Australian Labor Party
    According to Labor, the amendments to the United States Free Trade Agreement Implementation Bill 2004 that will "help ensure the PBS continues to deliver cheaper medicines". The media release from Mark Latham and Stephen Conroy indicated that the amendments will:

    1. Require patent holding companies to issue a certificate when they seek to use the courts to block cheaper generic drugs coming to market. Patent companies will be required to certify that the legal action has been commenced in good faith, has reasonable prospects of success and will be conducted without unreasonable delay. If the certificate is false or misleading, or if any undertakings given under the certificate are subsequently broken, the company can be liable for a civil penalty of up to $10 million for each contravention. The court can also order compensation be paid to the Commonwealth, and States and Territories, for losses sustained as a result of any interlocutory injunction obtained by the patent company. This provision mirrors the Government’s enabling legislation that requires generic companies to certify the patent status of new drugs on the market.

    2. Improve the prospects for generic companies, the Commonwealth and States and Territories to recover damages where an interlocutory injunction issued on behalf of a patent company unreasonably delays a generic drug coming onto the market. These damages would include any additional cost incurred by the Commonwealth under the PBS, and by the State and Territory public hospitals, due to any delay in getting a generic drug onto the market.

    3. Reduce the burden of proof on the generic companies issuing a certificate regarding the patent status of a drug – that is, reducing the burden of proof for certificates from absolute to ‘reasonable grounds’.

    The USPTO is reporting today that Steve Pinkos was sworn in on 9 August as the new Deputy Under Secretary of Commerce for Intellectual Property and Deputy Director of the United States Patent and Trademark Office. "Steve was most recently Deputy General Counsel and Staff Director of the House Judiciary Committee. In that capacity during the past 3 ½ years, Steve has worked on a wide variety of intellectual property and USPTO related issues".

    IPD Online Trade Mark Search (new link)
    The trade mark records of the registered trade marks and trade mark application pending before the Trade Marks Registry are now available for online searching. The online system contains the trade mark on the Hong Kong Trade Marks Registry. This database is hosted on the IPD website.

  • US - Internet Access to Patent Application Files Now Available
    "
    The system, known as Public PAIR (patent application and information retrieval), offers the public an advanced electronic portal to PDF viewing, downloading and printing an array of information and documents for approximately 500,000 patent applications not covered by confidentiality laws. As new applications become eligible for publication 18 months after they are filed, they will be added to the database. It is expected that about 300,000 application files will be added annually.

    Public PAIR builds on the USPTO’s year-old electronic IFW patent application file system, which is replacing paper files and is now used by over 95% of patent examiners to review applications. Public PAIR also offers a quick-click feature for ordering certified copies of patent applications and application files"

  • US - Trademarks Commissioner to Leave
    The Commissioner for Trademarks at the Department of Commerce’s U.S. Patent and Trademark Office (USPTO), Ms Anne Chasser has just announced that she will be leaving the USPTO on 1 September 2004. Anne Chasser was appointed Bill Clinton at the same time as Q. Todd Dickinson (former Commissioner).

    "Ms. Chasser joined the USPTO as special advisor in September 1999 and was confirmed by the U.S. Senate as Assistant Commissioner for Trademarks in November 1999. Following the enactment of the American Inventors Protection Act of 1999, Ms. Chasser was appointed Commissioner for Trademarks in March 2000".

  • Canada - CIPO Replaces EPO as International Searching Authority and International Preliminary Examining Authority
    The Canadian Intellectual Property Office has advised that as of 26 July 2004, the Canadian Intellectual Property Office (CIPO) has replaced the European Patent Office (EPO) as the competent International Searching Authority and International Preliminary Examining Authority. This decision applies to all Patent Cooperation Treaty international applications filed on or after July 26 by Canadian applicants with the Canadian receiving Office or the International Bureau of the World Intellectual Property Organisation as receiving Office. All such applications that were filed prior to July 26, 2004 will continue to have the international search and, where applicable, the international preliminary examination conducted by EPO.

  • New Zealand - Patents • Methods of Medical Treatment of Humans
    On 28 June 2004, the Court of Appeal in New Zealand in the of Pfizer Inc v Commissioner of Patents (CA22/03) issued a judgment in relation the methods of medical treatment of humans.

    "All three judgments of the Court conclude that “in terms of the present law, methods of medical treatment are not patentable” on the ground that it is generally inconvenient to protect them with letters patent or grants of privilege. The Court maintained that reform of this area of law is best undertaken through the Parliamentary process that would enable full consultation with any interested parties. The Court accordingly upheld the decision of Ellis J in the High Court and dismissed Pfizer’s appeal".

  • Macedonia - Turkey Cooperation
    The Industrial Property Protection Office of the Republic of Macedonia have posted news of the signing of a Cooperation Protocol By the Macedonian State Office of Industrial Property and the Turkish Patent Institute. It is unclear exactly what this cooperation will entail however the Macedonian Office made this statement:

    "The two Offices, joint by their common goal to improve the implementation of industrial property protection, believe that by signing this Protocol they will be able to make a more precise definition of their already long standing cooperation. The representatives agreed that at this moment areas of common interest are the automation of the workflow at the respective Offices, the internal organization of the offices and the possible exchange of experience about the membership in the European Patent Office......The Protocol also plans that by the end of this year experts from the two offices form a monitoring committee that will supervise the implementation of the Protocol".

  • Australia - Patent Database Changes
    The PatSearch (PAMS Online) patent database (the patent search system formerly known as NPS) has recently undergone some changes.

    The PatSearch (PAMS Online) database contains bibliographic information about innovation patent applications filed from 24 May 2001 and all new standard complete, provisional and innovation patent applications filed after the implementation of NPS Release 2.1 on 5 July 2002. IP Australia have improved the "useability" of the system by now displaying continuation/renewal fee details for all applications, except for PCT applications that have not yet entered national phase.

  • New Community Trademark Database
    The CTM-Online database has been upgraded since 16 July 2004. It now includes more information on the Community trade mark registration process and is updated daily. The database also provides better supporting information – via the help page, which now includes a glossary of statuses and information on Vienna codes. It also includes links to other databases, such as OHIM Case-Law (refusals, opposition, cancellation, appeals) and Curia, the European Court of Justice and Court of First Instance database.

  • STN International - New CSA Databases
    News from STN (FIZ Karlsuhe), who have announced that they have added 7 new databases from database producer CSA to the STN International online service.

    ANTE covers new technologies such as information technology and computing, electronics, biotechnology, medical technology, as well as engineering (including construction, electrical and chemical engineering) and allied subject areas. Sources are a large number of academic and trade publications from the U.K. and the U.S.

    Technical information is also provided by the two engineering databases
    CIVILENG and MECHENG covering worldwide literature on civil engineering (CIVILENG), mechanical and transportation engineering (MECHENG) and their complementary fields, including forensic engineering, management and marketing of engineering services, engineering education, theoretical mechanics and dynamics, and mathematics and computation.

    Information on environmental issues is available in three of the new databases:
    ENVIROENG covers the world literature pertaining to technological and engineering aspects of air and water quality, environmental safety, and energy production. WATER and AQUALINE cover international scientific, technical and trade literature on water-related topics and all aspects of water resources, including supplies management, water legislation, water quality, potable water distribution, wastewater collection, water treatment technologies, wastewater and sewage treatment, and ecological and environmental effects of water pollution.

  • STN - 2 - BEILSTEIN Enhancements
    Beilstein on STN has been enhanced with new features developed with "patent searchers in mind":

    1. Patent Numbers (PN) can now be SELECTed and TRANSFERed

    Patent Numbers (PN) were previously only searchable, but now they can also be SELECTed and/or TRANSFERed for searching in other STN files.

    2. BABS Accession Numbers can be searched, SELECTed and TRANSFERed

    The BEILSTEIN Abstracts Database (BABS) contains bibliographic data, titles and abstracts for all references in BEILSTEIN from 1980 to date. BABS Accession (Abstract) Numbers are now searchable and SELECTable in BEILSTEIN, greatly improving crossfile searching between the two files.

    3. All references to a compound can be displayed in a single format

    Three new display formats, ALLREF, ALLP and BABSAN, can be used to display all unique references, all unique patent references or all unique BABS Accession Numbers (BABSAN) respectively for a BEILSTEIN substance record. The new display formats combine references from property data fields and BEILSTEIN reaction documents into a single deduplicated list.

  • Iceland - Patent Act Amendments
    The Icelandic Patent Office has advised this week (14 July) that amendment to the Iceland Patent Act has been passed by parliament. Amendment Act nr. 53/2004 to change the Patent Act, no. 17/1991, to conform to the European Patent Convention entered into force on June 14th.

    In addition the Patent & Trademark Gazette will now be published electronically from the 15th July 2004 issue. They will only be available electronically unless you venture to the Patent Office which will supply a printed version for a fee.

  • Taiwan - Trademarks - Registering 3Ds, Colors, and Sounds as Trademark
    The Intellectual Property Office of Taiwan has advised that they have prepared and drafted examination guidelines which published on 1 July 2004. These guidelines deal with 3D marks, Color marks and Sound marks.

    Under amendments to legislation in 2003, which bring Taiwan into line with other jurisdictions, , 3D, color, and sound marks are now protected under the Trademark Act. Since its implementation on 28 November 2003, the TIPO has received over 100 applications for 3D mark registration, some 60 applications for color mark registration, and over 20 for sound mark registration, marking a combined total of approximately 200 applications.

  • Europe - Oncomouse Patent - Update
    For those of you who have been following the "Oncomouse" Patent (EP0169672), some further news from the European Patent Office.

    "Munich, 6 July 2004-- As a result of an appeal decision, European patent EP 0 169 672, better-known as the “Oncomouse” patent, has been further restricted.

    In 1985 the President and Fellows of Harvard College, Cambridge, Massachusetts, USA, applied for a European patent entitled “Method for producing transgenic animals”. The patent was granted in May 1992 in respect of “non-human mammalian animals” for eleven member states of the European Patent Organisation.

    Seventeen oppositions against the patent, filed in 1992 and 1993, led to the decision in November 2001 to maintain the patent in respect of “transgenic rodents”. Several appeals against that decision lodged in March 2003 were heard by the Technical Board of Appeal which decided to restrict the patent further to “transgenic mice”.

  • Estonia - Filing Activity Report
    The Estonian Patent Office has just published details of the Filing activity of applications for legal protection of industrial property in the first half of 2004. It is good to see a Patent Office publish figures for the current year, normally we need to wait until mid way through the next calendar year to find out information about patent filings.
