  • SAEGIS - Trademarks in Colour
    The most recent enhancement to the SAEGIS system is the inclusion of colour images for the following registers:

    * Benelux
    * Community Trademarks
    * Denmark
    * France
    * International Register
    * Germany
    * United Kingdom
    * Spain

    The enhancements allow users to view device marks in their original filed colour. Additional enhancement now allow for improved quality of the black & white images

  • Singapore - Proposal To Revise The Patent System In Singapore
    The Intellectual Property Office of Singapore (IPOS) has released information on the proposal to revise the patent system in Singapore.

    The consultation paper released seeks users views on the changes that IPOS is proposing to the Patent System in Singapore. These comprise:
    (a) Changes to the time periods for the patent search and examination process and the
    payment of patent grant fees; and
    (b) Other proposals to make the current patent system more robust.

  • USA - USPTO Industry Day (22 May 2003)
    The United States Patent and Trademark Office (USPTO) is holding a 21st Century Strategic Plan "Industry Day" at their Arlington office. "The 21st Century Strategic Plan is a roadmap guiding the transformation of the USPTO into a quality focused, highly productive, responsive organization, supporting a market-driven intellectual property system".

    "Industry Day is designed to educate potential vendors about the products and services the agency will need to support its 21st Century Plan initiatives.   • Europe - Unbilical Cord Blood Patent Appeal Decision
    The European Patent Office has reported that on 7 April 2003, the technical board of appeal of the European Patent Office (EPO) upheld the revocation of Biocyte’s European patent describing inter alia the use of umbilical cord blood. The board ruled "that the subject matter of the claims defended by the patent proprietor was not new vis-à-vis the state of the art and as such failed to meet the novelty requirement under Article 54 of the European Patent Convention". The patentee lodged an appeal against the opposition division's decision in 1999 to revoke EP343217.

  • Special - World Intellectual Property Day highlights Value of Intellectual Property to Business and Society

    Following is a reproduction of the press release from WIPO marking World Intellectual Property Day 2003.

    The Director General of the World Intellectual Property Organization (WIPO) marked this year’s World Intellectual Property Day with a call for society to be more involved in matters relating to intellectual property. "Making intellectual property your business" the theme of this year’s World Intellectual Property Day on April 26, 2003, highlights the key role of intellectual property both in achieving business success and in enhancing our daily lives. It is an appeal for entrepreneurs to fully capitalize on their intellectual assets by using the tools of the intellectual property system to advance their business goals and a wider call for civil society to recognize that respect for intellectual property rights is of benefit not only to creators but to society as a whole.

    Within today’s increasingly knowledge-based, innovation-driven economies, the intellectual property system is key to wealth creation as it provides an incentive for enterprises and individuals to create and innovate, provides a fertile setting for the development of, and trade in, intellectual assets, and creates a stable environment for domestic and foreign investment.

    To mark the occasion, the Director General of WIPO, Dr. Kamil Idris, released the following message:

    "Making intellectual property your business – the theme for this year’s World Intellectual Property Day – highlights the key role of intellectual property both in achieving success for business and in enhancing daily life for us all.

    It is an appeal to entrepreneurs to fully capitalize on their intellectual assets and to use the tools of the intellectual property system to advance their business goals. A company’s intangible assets - ranging from human capital and know-how to inventions, brands, designs and other products of its creativity and innovation – are, today, often more valuable than a company’s physical assets. Intellectual property is a vital ingredient in securing the commercial success of any company wishing to stay ahead of the field in creating innovative new products, finding modern and cost-effective ways to manufacture old ones, expanding market-share and generating customer loyalty. It is therefore in the interests of business to make best use of their intangible assets by embracing the opportunities offered by the intellectual property system.

    Making intellectual property your business is also a wider call for civil society to recognize that respect for intellectual property rights is of benefit not only to creators but to society as a whole. The intellectual property system enables innovators and creators to mint marketable inventions and works from the raw material of their artistry and ingenuity. This makes the intellectual property system a driver of technological development and ensures a force for the enrichment of our global cultural heritage, and a powerful tool for wealth creation for the benefit of all.

    The history of human progress is one of opportunity. Today, universal acceptance and the strategic use of intellectual property offers an opportunity for individuals, businesses and countries to convert their creative resources into economic assets capable of generating wealth and contributing to a more secure future. A strong national commitment to the intellectual property system ensures the establishment of an environment within which the creative and innovative potential of a country may flourish.

    Intellectual assets are the principal currency of today’s knowledge economy. Economic success, and associated social and cultural benefits, hinge on the generation and management of innovation, information and ideas. Harnessed by the intellectual property system, these drive the incredible forward thrust of technological and cultural development and thereby spawn new growth industries.

    WIPO proclaims the universal value of intellectual property, which marks the world’s evolution, contributes to the progress of societies and is a key element in securing sustained economic, social and cultural development. Creativity is an infinite resource, native to all peoples and relevant to all times and cultures. Let us forge our common future today by embracing intellectual property as a way to use that creativity for the betterment of humankind."

    In 2000, member states of the World Intellectual Property Organization (WIPO) designated 26 April, the date on which the Convention establishing WIPO entered into force in 1970, to celebrate the contribution made by innovators and artists to the development and growth of societies across the globe and to highlight the importance and practical use of intellectual property in our daily lives.

    To mark the occasion in Geneva, a local cinema, the CAC Voltaire, will screen two classic films on April 26th, both related to intellectual property, namely, Fountainhead (1949) directed by King Vidor and Tucker: The Man and His Dream (1988) directed by Francis Ford Coppola. These films respectively, tell the stories of Howard Roark, played by Gary Cooper and Preston Tucker, played by Jeff Bridges, and their individual struggles to protect and earn a living from their ideas.

  • Derwent- Web-based Patent Alerting Service
    Thomson Derwent has recently announced the launch of "Patent ProfilesNet". This is a new Web-based patent alerting service which provides alerts based on original patent documents from major patent offices worldwide. The reports/alerts are delivered in HTML format within days of publication. The records include:

    - patent’s bibliographic data
    - main claim
    - abstract
    - drawing

  • Papua New Guinea and the Syrian Arab Republic Join PCT
    WIPO has announced that Papua New Guinea (PG) and the Syrian Arab Republic (SY) have become the 119th and 120th PCT Contracting States to the PCT. They will join on 14 March 2003 and 26 March 2003, respectively. Accordingly, the PCT will enter into force for Papua New Guinea on 14 June 2003 and for the Syrian Arab Republic on 26 June 2003.

  • Obtaining GB "B" Documents
    Stephen Adams (patent information guru from the UK) has posted to the PIUG list a work around for obtaining British "B" documents from the espacenet servers. Thanks Stephen!

    "For British granted patents, there is supposed to be a work-around until the proper links are loaded into the espacenet database. What you have to do is to go into the worldwide database, call up the PDF of the GB-A document, then change the URL by replacing the A document kind with a B e.g.

    I have reported earlier on this software, and I have been so pleased with IP-Discover Lite that I recently decided to upgrade to the full version "IP-Discover 2003 Professional". The software provides a great way to search and download specifications from either the USPTO or ESPACENET servers. One of the great features in the professional version is the addition of titles to the documents in the browse window.   • WIPO - Change in Dates of Beijing Summit
    The Director General of the World Intellectual Property Organization (WIPO), Dr. Kamil Idris has just advised that the WIPO Summit on Intellectual Property and the Knowledge Economy, and the accompanying Industry and Private Sector Forum in Beijing, will not take place as scheduled from 24 to 26 April 2003. The postponement is due to "prevailing circumstances" which we can assume includes Iraq and SARS. WIPO have advised that new dates and information will be provided "in due course".

  • Europe - EPIDOS Online News Issue 1/03
    The new EPIDOS Online News (1/03) is now available from the European Patent Office. Articles include:
    A look forward before retirement - As her career at the EPO draws to a close, Liliane Meyers, Principal Director for Patent Information, highlights some of the most important changes currently taking place in European patent information.
    On-going developments to esp@cenet - More national servers and data have been added recently to the esp@cenet service; a new "esp@cenet information centre and forum" is in preparation; and the renowned INPADOC data will soon be integrated into esp@cenet.
    EPO patent information survey - The EPO's survey of patent information needs in Europe has made good progress. Observations from the pilot survey suggest that companies are prepared to pay for patent information, but internet penetration is not as widespread as was expected.
    IPC reform ready for 2005 - On 1 January 2005, a "reformed" edition of the IPC will enter into force. Meanwhile, developments to the ECLA classification scheme at the EPO and the trilateral "Harmony" project will also have an impact on the way patent documents are classified.

  • SAEGIS - Trade Marks - Hungary, Poland and Czech Republic
    The most recent edition of "FLASH", the SAEGIS newsletter indicates taht Compu-Mark now have three new central European databases available on SAEGIS: Hungary, Poland and Czech Republic.

    The new databases include "....the current status of a trademark, as far as the information is published in the Official Traemark Gazettes...full text information containing the trademark, application number, international class(es), status, goods and services descriptions, current owner information, dates and other pertinent information including Vienna codes and images".

    The Hungarian and Czech Republic databases are updated monthly and the Polish will be updated quarterly.

  • WIPO - World Intellectual Property Day - 26 April 2003
    Well it is fast approaching that time of the year again. World Intellectual Property Day is the 26th of April and this year's theme is "Make Intellectual Property Your Business". WIPO has prepared an information kit for Member States which includes:
    - a message from WIPO Director General Kamil Idris
    - the overview and CD-ROM versions of the book Intellectual Property – A Power Tool for Economic Growth
    - the new Intellectual Property for Small and Medium-Sized Enterprises CD-ROM
    - the Patent comic strip and posters and bookmarks with the above theme.

    Delphion have also introduced a new family legal status report. This allows you to see the legal status for all members of a patent family "in one convenient, easy to read, printer friendly report". You can access the report from the Delphion Integrated View. Premier subscribers can try the report free through April 30 ($5 beginning May 1). The report is always free for Unlimited subscribers.

    A very welcome enhancement comes in the form of date formatting. Delphion has adopted the ISO date format throughout their site. Now all dates are shown in ISO format YYYY-MM-DD.

  • Australia - Analysis of the Legal Framework for Patent Ownership in Publicly Funded Research Institutions
    IPRIA (Intellectual Property Research Institute of Australia) has just released a report by Andrew F. Christie, Stuart D'Aloisio, Katerina L. Gaita, Melanie J. Howlett, and Elizabeth M. Webster which is called an Analysis of the Legal Framework for Patent Ownership in Publicly Funded Research Institutions.

    IPRIA's report to the Department of Education, Science and Training examined the legal framework for patent ownership in publicly funded research institutions in the United States, Canada, the United Kingdom and in Australia. The report found that experience has shown in the United States, Canada and the United Kingdom, that the optimal initial owner of a patent for an invention is the research institution in which the invention was created. Research institutions are best placed to implement management structures to identify potentially valuable patents and they are also well positioned to pursue commercialisation of such inventions. The default position should not vest ownership of patents in employee inventors or funding agencies. However, whilst there should not be an automatic devolution of patent rights to employees or funding agencies, research institutions should be allowed the freedom to assign patent rights on a case by case basis where the institution believes that such an assignment would lead to an optimal outcome with respect to commercialisation.

    The report recommended that the right to ownership of patents should be coupled with the assumption of responsibility for the effective identification, protection, management and commercialisation of the invention. This approach could be implemented by the adoption of a policy requiring certain federal government funding agencies to make grants to research institutions conditional upon the acceptance of the responsibilities recommended above. In particular, it could be implemented through an expansion of the approach already operating in Australia via the National Principles and the Interim Guidelines. This "expanded National Principles approach" would enlarge the content of the responsibilities currently applied to research institutions, as well as the range of funding agencies applying those responsibilities.

    Piers Mason at Research Disclosure has informed me that their long-established defensive publication journal Research Disclosure (RD) has been joined by a full-text searchable online version, RD
    Electronic. This can be found online at researchdisclosure.com.

    "For over 40 years Research Disclosure has held an unrivalled place as the primary rapid-disclosure mechanism for companies and individual inventors wishing to place their research findings in the public domain. Research Disclosure accepts and publishes descriptions of inventions from all technical fields - chemical, electrical and mechanical - rapidly and conveniently, as a monthly journal".

    Piers says that the "introduction of the RD Electronic service makes the disclosure procedure much easier with the publishers now able to accept files via e-mail, and a single fee covers publication in both electronic and paper format. Inventors can choose to have their disclosure published in electronic form immediately on receipt or have it held back to coincide with the production of the next monthly paper journal".

    What is also pleasing to see is that the current release of RD Electronic also provides full-text searching of all disclosures back to 1979. Documents can be viewed in PDF format. The publishers are releasing the full back-file to 1960 in the next two months.

  • Europe - EPO In Disagreement on New President
    There has been a lot of email in the last few days relating to the struggle the EPO members are having in deciding on a new President. According to Ted Blake from CIPA, at their meeting on 20 March 2003, the European Patent Organisation's Administrative Council could not agree upon a successor to Ingo Kober as President of the European Patent Office (EPO). "The Council has therefore agreed to rerun the process in June with Member States having until 9 May to nominate candidates. The UK's candidate Alison Brimelow, Chief Executive of the UK Patent Office, topped the poll in the first round of voting but failed to secure the required three quarters of the votes".

  • STN - German Full Text Patents (PATDPAFULL)
    STN have announced the release of PATDPAFULL. This database is produced by German Patent & Trademark Office (DPMA), and is a fulltext patent database providing German language access to German patent and utility documents in all technologies. The file currently contains 433,000 records covering:

    - German Patent Applications since 1996
    - Granted Patents since 1997
    - German translations of European Patent Documents since 1999
    - German Utility Models since 1996 (biblio & claims only)

    STN have advised that backfile data will be loaded continuously throughout April so that the following data should be available by the end of the month:

    - German Patent Applications since 1987
    - Granted Patents since 1990
    - German translations of European Patents* since 1992
    - German Utility Models since 1996 (biblio & claims only)

    The database is updated weekely, within two or three days after publication. The file supports simultaneous left and right truncation in the basic index which I think would be very useful for non German speakers searching the database.

  • WIPO - Member States Unanimously Recommend the Appointment of Dr. Kamil Idris for a Second Term as WIPO Director General
    WIPO has reported that a "key decision making body" of the World Intellectual Property Organization (WIPO) has unanimously decided to recommend the appointment of Dr. Kamil Idris as Director General for a second six-year mandate. This needs to be endorsed by the WIPO General Assembly.

    "The WIPO Coordination Committee consists of 79 member states and under the terms of the "WIPO Convention" it is required, when the term of office of the Director General is about to expire, to nominate a candidate for appointment to such position by the General Assembly. Dr. Idris’ candidature was the only nomination received for consideration by the Coordination Committee".

The update corrects changes made to the JPO server.  Version 2.x is a Shareware program, however there is a freeware versions with certain limitations.    These limiations are removed when you register the product.  The cost is US$89.00 to get the registered version. It should be noted that the tracking or statistic feature which concerned many users is now removed in the licenced version.

  • IPI-ConfEx 2004 - Call For Papers
    Further to our news earlier this week on the IPI-Confex 2004 conference and exhibition in Europe, IP Menu can report that the organisers are now calling for papers. This new International Patent Information Conference and Exposition (IPI-ConfEx) is to be held in Lisbon in March 2004. It is designed to give European patent information users the opportunity to share their searching and information management knowledge and experience. From the organisers:

    "We are particularly interested to hear from corporate, patent office, or law firm patent information users who are able to discuss methods (preferred) and/or tools used within their organizations for patent monitoring. For example, consider comparative studies or approaches for handling:

    - Current awareness patent information on specific subjects,
    - changes in legal status, classification, or indexing,
    - key user needs (for R&D, law department, managers, etc.),
    - content filters and customized distribution of patent alerting info.,
    - updates into existing corporate databases,
    - cost vs. value issues for specific patent monitoring tools or databases,
    - preferred database structures and system compatibility, etc.

    Papers on other topics are also desirable, for example, tips and techniques for doing patent research, such as, how to effectively use Japanese F/FI-terms, USCL, ECLA or IPC classifications.

  • Preview Version of esp@cenet 3
    Ed Winckel from Shell International BV has reported to the PIUG list that the preview version of esp@cenet 3 is now available. According to Ed, over the next few months new functionality will be added such as a link to the Inpadoc family and legal status data and a new interface for searching ECLA codes. This current preview version allows record to record browsing and de-duplication of results.

    This new version is expected to go live around July 2003.

    "The major changes introduced in this new version are all concentrated in the area of the user interface. The basic search, retrieval and display functionalities remain unchanged. This prototype, which is being made available for final test and evaluation purposes, contains the majority of features that will ultimately be made available in the officially released version, although it should be noted that access is currently only being offered to the Worldwide and Patent abstracts of Japan databases, and not at this stage the complete set of national esp@cenet databases. In addition, the user interface is currently only offered in English. The prototype is being made available in parallel with the current esp@cenet service, and it is not currently planned to finally replace this current version until the end of the second quarter 2003".

    Ford Khorsandian is known, among other things, for having spearheaded the concept of the International Patent Information (IPI) Award, which made its debut in 2000. Ford Khorsandian explains: “The IPI Conference and Exposition in Europe is designed to support patent information professionals in their work by providing a venue for learning about the latest technical developments in the industry. It also provides a forum for the exchange of ideas. It is the practical experience of the patent information users and their feedback to the information suppliers that often gives rise to the next generation of innovative new tools and services.   • RAPIDPAT Introduces Patent and Trademark Digital LIbraries(tm)

Delivered on CD or DVD, Rapidpat's Digital Libraries unite document copies and full-text data of the patents and trademarks that uniquely affect an organization's interests".

    "Rapidpat Digital Libraries provide a centralized data repository with search, retrieval and access functionality unique to an organization's needs.     One of the interesting things about Rapidpat's system is their proprietary compression technology that achieves between a 12:1 and 15:1 ratio of compression over standard PDF documents. The average patent in standard PDF format is 1.5 megabytes, while the average Rapidpat PDF document weighs in at just 100k-without quality loss. The Rapidpat compression technology can also be used to reduce the size of existing data sets such as prior art and other materials which can then be integrated into your local database.

  • Europe - CIPA - EU Council Agrees on Community Patent
    CIPA has reported that the EU Council has agreed on a Community Patent. "At its meeting on 3rd March, the EU's Competitiveness Council agreed on a common political approach regarding the Community Patent. Discussions were based on a compromise proposal put forward by the Greek Presidency of the EU".

    Applications for Community Patents must be filed in one of the official languages of the EPO, or if in a non-EPO language it must be filed with a translation into one of the EPO languages. After grant, the applicant must file a translation of all the claims into all official EU languages, unless a state renounces the need for a translation into its official language".

  • Canada - Trademarks - Vienna Classification Adopted
    CIPO has adopted the Vienna Classification which provides a list of symbols used to classify the figurative elements of trade-marks. This classification is now searchable on the Canadian Trade-marks Database. The Vienna Classification is based on the Vienna Agreement Establishing an International Classification of the Figurative Elements of Marks. This multilateral treaty is administered by the World Intellectual Property Organization (WIPO) and entered into force in 1985.
