New Version 2.5.13 Now Available
GetIPDL
have released another update to their Patent Downloading software.
Version 2.x is a Shareware program,
however there is a freeware versions with certain
limitations. These limiations are removed when you register the
product. The cost is US$89.00 to get the
registered version. It should be noted that the tracking or statistic
feature which concerned many users is now removed in the licenced
version.
The new version allows downloading of the full text and images from
WIPO.

NIPRA Begins USPTO Fight
Again
The National Intellectual
Property Researchers Association (NIPRA) have filed a second action in
the US seeking to block the USPTO plan to eliminate the public patent
and trademark collections.

"WASHINGTON, DC June 19 - The National
Intellectual Property Researchers Association (NIPRA) today filed a
second action in the US District Court for the Eastern District of
Virginia, seeking to bring the United States Patent and Trademark
Office (USPTO) into compliance with section 4804(d)(2) of the American
Inventors Protection Act. This action seeks to block the new USPTO
plan to eliminate the public patent and trademark paper collections,
critical collections relied upon for accurate intellectual property
research.
The lawsuit seeks to enjoin the USPTO from its announced plan to
resume dismantling its paper collection of patents and trademarks.
Despite overwhelmingly negative comment and public surveys
demonstrating the public reliance on the collections, the USPTO has
ignored public outcry and again embarked on the destruction of the
country’s most valuable Intellectual Property resource.
As a result of the initial action filed by NIPRA, the USPTO rescinded
its earlier certification to Congress and instituted an expedited plan
to resume updating and maintenance of the paper collections.
Subsequently, that plan was included as part of the settlement
agreement executed by the parties in April of 2003. In exchange for
the provisions of the plan and recovery of its legal fees,
NIPRA agreed to a stipulated dismissal without prejudice".

Canada - Fee Review
The Canadian Intellectual Property
Office has just published a notice on the CIPO Fee Review - "Fee and
administrative changes amending the Patent Rules, the Trade-marks
Regulations, the Industrial Design Regulations and the Copyright
Regulations".
The changes to the Rules amending the Patent
Rules as well as Regulations amending the Trade-marks Regulations
(1996), the Industrial Design Regulations and the Copyright
Regulations were published in Part II of the Canada Gazette on June
18, 2003.
The majority of administrative changes to the Patent Rules and
Copyright Regulations came into effect on June 5, 2003. The majority
of fee changes will come into force on January 1, 2004.
Fee and administrative changes in relation to the functioning of CIPO
as an International Searching Authority (ISA) and International
Preliminary Examining Authority (IPEA) will enter into force in the
second half of 2004.

United Kingdom - Trade Mark Disputes "De-Mystified"
The United Kingdom Patent Office has
release a new video that "de-mystifies" the trade mark dispute
process.
"The Patent Office is providing help to parties
involved in trade mark disputes, in the form of a new video. Private

USPTO - Trilateral Meetings Advance
21st Century Strategic Plan
A report from the USPTO on the third
trademark trilateral cooperation meeting and the patent Trilateral
Technical Meeting.
"The third trademark trilateral cooperation
meeting was held in Tokyo on May 27 and 28, followed by the patent
Trilateral Technical Meeting on June 10-12. Officials from the world's
three major intellectual property offices-the USPTO, the Japan (JPO)
and European (EPO) patent offices-attended the sessions. "I am pleased
to report that the meetings were highly productive and furthered the
goals of the 21st Century Strategic Plan," said Under Secretary of
Commerce for Intellectual Property James E. Rogan.
Trilateral cooperation directly promotes international harmonization
of IP rights around the world. In their discussions regarding a common
international trademark application, improved search and patent
quality, and electronic filing and processing of patent and trademark
applications, the three offices agreed to:
- produce a list of identifications of goods and services under the
Nice classification system that are acceptable to all three offices;
- develop a trilateral Web site;
- adopt a comparative study on examination practices relating to
Single Nucleotide Polymorphisms (SNPs) and Haplotypes (multiple SNPs
on a polynucleotide);
- continue discussions and work in the area of electronic filing and
processing;
- continue to work on revising the PCT Search and Examination
Guidelines; and
- work together on strategic issues including fee policy, the reform
of the PCT and the feasibility of establishing best practices in
support of patent law harmonization.
The heads of the three offices will meet at the annual Trilateral
Conference in Tokyo this November".

Australia - Still More
Problems with the "New Patent Solution"
It
seems the only time Australian IP gets a mention on IP Menu News is to
report another problem with their NPS (New Patent Solutions) database.
Today is no different. It seems that some data on the NPS is wrong. A
particular case in point is innovation patent record 2001100568. It
lists the "Date Accepted" as 27 May 2003 and the "Date Certified" as
21 November 2002. In fact the dates should read "22 January 2001" and
"15 October 2002" respectively.
An isolated incident? Apparently not. IP Australia have admitted that
they are aware of a problem whereby there is a "corruption" of data in
the transfer from their online file system to the new NPS system.
Unfortunately, we don't know the extent of this problem and how many
dates are incorrectly appearing in NPS. For those of us who regularly
watch an application for opposition purposes this is a nightmare
scenerio.
We will keep you updated with the next chapter of what is becoming a
very sorry saga.
One day I hope to have something positive to report from IP Australia!

2003, Egypt (EG) became the 121st PCT Contracting State. The PCT will
enter into force for that State on 6 September 2003. Further

Design Bulletin Search Now Available

OHIM have announced a new search feature for the Community Design
Bulletin. The Community Designs Bulletin is only published in
electronic format (PDF), as a multilingual edition in the eleven
official languages of the European Union.
It comprises three parts:
Part A – Registrations of Community designs
Part B – Entries in the Register subsequent to registration
Part C – Renewals and information on expired registrations
It may be viewed in PDF or can be searched using the
new search
interface on the OHIM website.

CIPA - New President
Congratulations go to Dr Anna
Denholm, the new President of CIPA.
The Chartered Institute of Patent Agents (CIPA) is the professional
body representing Patent Attorneys in the UK. CIPA was founded in 1882
and incorporated by Royal Charter in 1891.
Anna has a B.Sc. in Agricultural Biochemistry and a Ph.D. in
Biochemistry from the University College of Wales, Aberystwyth. After
being awarded her doctorate she continued her research career as a
university postdoctoral scientist both at Bangor and Aberystwyth.
She joined the patent profession in 1988 and has spent most of her
time working in industry. She is qualified as a European Patent
Attorney and Chartered Patent Agent and has an LLM in Advanced
Litigation (The Nottingham Trent University) and a CIPA Litigator
certificate. In 2001 she joined a firm of European Patent and Trade
Mark Attorneys.

The enhanced patent delivery ensures extensive coverage from over 40

The shopping basket's enhancements let users track patents with patent

to announce the release the first product resulting in their
partnership announced earlier this year.
The anacubis Viewer has been integrated into QPAT for patent citation
analysis and visualization. This feature, now included in all QPAT
subscriptions, lets users explore the complex relationships between

inventors and ECLAs and USPCLs.

IP Australia
IP Australia has made quite a
mess of the "New Patent Solutions" (NPS) database, so much so that
searching Australian patent information has now become a nightmare
fraught with dangers, errors and omissions! The system in place prior
to NPS, the Patent Administration system, whilst being a bit
antiquated contained accurate information and searching it was a
reliable affair. Not so with NPS!!. We are continually promised
that the NPS system will be fixed although it seems that the only
information we do receive from IP Australia these days is the
announcement of another problem with the system! At least they are
getting something right with their Tertiary Resources material on
their
IP Professor website. The site is aimed at educators and provides
some excellent material for those starting out their career in IP.
Mind you...if the extra resources IP Australia directed towards this
project were actually directed back at NPS...who knows.....we may have
a system that works!

Organization (WIPO) on Tuesday May 27, 2003. Dr. Idris received

One of my
favourite websites is Austlii.
It is a powerhouse of free legal data on the Internet and since it's
inception has been recreated in other forms around the world
- Bailii,
Canlii,
Paclii,
Worldlii and
Hklii. Austlii are holding their
5th Conference on Computerisation of Law via the Internet at the
University of Technology, Sydney, Australia, from 26-28 November 2003.
"The Australasian Legal Information Institute,
one of the largest free access law sites on the web, will host the
fifth Law via the Internet conference on 26-28 November 2003. The
Conference venue is in the centre of Sydney's restaurant and
entertainment districts and Harbourside attractions. Previous Law via
the Internet Conferences have been hosted by AustLII in Sydney (1997,
1999 and 2001), and by CanLII/LEXUM in Montreal (2002)".

papers. The conference proper will take place on 27-28 November,

5,000 Cybersquatting Cases Under UDRP
Cybersquatting is still alive and
well if figures from WIPO are any indication.
"The Geneva-based Mediation and Arbitration
Center of the World Intellectual Property Organization (WIPO) received
its 5,000th domain name case under the Uniform Domain Name Dispute
Resolution Policy (UDRP) this month as English football club Tottenham
Hotspur kicked off proceedings to win back its Internet identity from
an alleged cybersquatter. In addition to the 5,000 cases received
under the UDRP, the Center has handled over 15,500 cybersquatting
cases under specific dispute resolution policies, bringing the total
number of cybersquatting cases filed with WIPO to 20,511.
Coincidentally, the first domain name case received by WIPO in
December 1999 was filed and won by the World Wrestling Federation,
another sporting entity. Scores of sports-related cases have been
filed and resolved under the UDRP".

US - Claims Reassignment Records
Updated
IFI Cliams Patent Services have
announced a recent update to US Reassignment records on the Claims
Legal Status databases. CLAIMS Legal Status through Dialog File 123,
Questel-Orbit file CRXX, and STN file IFICLS. The database has been
updated and is now current with data available from the USPTO through
April 14, 2003. This update affects over 10,000 US patent records in
the CLAIMS database.

however there is a freeware versions with certain

Europe - The Extended European Search Report
As
of 1 July 2003 the EPO will commence a pilot project for EP first
filings (ie applications claiming no priority), which will involve
issuing to the applicant, together with the search report, an opinion
on whether the application and the invention to which it relates meet
the requirements of the EPC (Extended European Search Report, EESR).
This opinion will consist either of the text of the first examination
communication where all the objections to patentability are addressed
or of a positive statement which would allow the application to
proceed to grant.
The non-binding opinion on patentability will be issued free of charge
as a service. No time limit will be set for reply, nor does it affect
the period for requesting examination, ie for paying the examination
fee under Article 94(2) EPC. The opinion issued along with the search
report may, however, be used by the applicant as the basis for an
informed decision as to whether he wants to pursue the application
further or not.

Soya Patent Decision
I am aware that many people
have been following this case before the EPO. Following is, in part,
the Press Release from the EPO:
"Soya" patent limited after hearing in
opposition proceedings before the European Patent Office
Outcome of oral proceedings relating to Monsanto patent
Munich, 6 May 2003 - The so-called "soya" patent owned by Monsanto (EP
301 749 B1) is to be limited. The Opposition Division of the European
Patent Office (EPO) came to this decision today after a public hearing
in opposition proceedings. In March 1994, the EPO granted Agracetus,
subsequently taken over by Monsanto, a patent for twelve of the
current 27 member states of the European Patent Organisation. In its
original form, the patent describes a process for genetically
engineering plants, in particular soybean plants.
The Opposition Division takes the view that the granted patent does
not meet the requirement for sufficient disclosure. Under Article 83
of the European Patent Convention (EPC), the description of an
invention has to be sufficiently clear and complete for it to be
carried out by a person skilled in the art. In its limited form, the
patent now relates only to soybean plants, not generally to any kind
of plant.
The parties can contest the outcome of today’s hearing in appeal
proceedings before one of the EPO's Technical Boards of Appeal. The
reasons for the Opposition Division’s decision, setting out a full
assessment of the facts and arguments, will be published at a later
date.

Tony Trippe has just launched
Patinformatics.com and a
weblog at the PIUG Annual Conference. Patent analysis is the theme of
this years conference and Tony's website looks like it is going to
make a signifcant (and ongoing) contribution to this very interesting
and challenging area of patent analysis. Anyone who has an interest in

MicroPatent - Enhancements
MicroPatent has announced today (5 May 2003) at the annual Patent
Information User Group (PIUG) meeting in Chicago, the launch of three
system upgrades: a new PatentWeb® navigation tool, additional German
data, and improved date range options in PatSearch FullText.
“We’re continually looking for ways to improve
our user’s experience, while simultaneously providing new content for
our customers to search and analyze,“ said Bill Chambers,
MicroPatent’s chief operating officer.
“Today’s releases are significant in that they accomplish all of the
above, in time to share with attendees of the industry’s premier
patent conference, PIUG, many of whom are customers. Additionally,
these system enhancements mark the beginning of a series of
substantial product launches coming over the next several months.”
"PatentWeb’s
new navigation tool allows searchers to easily move from one search
environment to another (according to their subscriptions), access a
personal repository of their MicroPatent information, order and
retrieve documents (including file histories), and link to other
MicroPatent product information. Customers can quickly navigate
throughout the PatentWeb, easily transitioning to the different
services they need to complete their work while simultaneously
building and accessing a personal directory of MicroPatent
information.
The new German data consists of DE-T and DE-U documents, available in
PatSearch FullText. DE-T documents are translations of EP and PCT
publications into German. DE-U records are Utility Models (Gebrauchsmuster).
Both of these collections contain bibliographic data only, ranging
from 1989 to present (abstracts and full text are not available). With
this additional data, customers get broader data coverage, and hence
more comprehensive results, in addition to being able to download DE-U
and DE-T1 records as document facsimiles.
The new PatSearch FullText date range options let customers better
qualify their search strategies and more efficiently execute their
research. There are two date sets, one for searching from the most
recent date backward in time, and the other for searching sequential
time segments, of particular benefit for complex search strategies
that require multiple executions to complete.
Additional product releases scheduled for this quarter include a new
and improved alert product, the integration of MicroPatent’s full text
data into the Aureka system, the ability to create theme maps on both
patent and non-patent literature in Aureka, command line interface
searching, and improved functionality in MPI, MicroPatent’s Patent
Index database".

WIPO Launches New IP CD-ROM
for SMES
The World
Intellectual Property Organization (WIPO) launched this week an
updated version of its CD-ROM entitled "Intellectual Property for
Small and Medim-Sized Enterprises (SMEs). The CD-ROM, free of charge
and available in six languages (Arabic, Chinese, English, French,
Russian, and Spanish) is part of the Organization’s efforts to raise
awareness about the role of intellectual property (IP) in leveraging
business development and improving competitiveness among the global
SME community.
"The new CD-ROM includes case study material,
outlines best practices and explains in very clear, user-friendly
terms, a broad range of practical intellectual property issues of
interest to SMEs and SME support institutions across the globe. These
include: Intellectual Property for Business; Intellectual Property and
E-Commerce; over 20 ‘best practices’ for promoting use of IP by SMEs
and selected SMEs Support Institutions worldwide over 20 case studies
on the use of IP for successful business development , and a wealth of
documents, including presentations, articles, interviews on the
various activities of the SMEs Division. The CD-ROM is available to
public and private IP institutions, chambers of commerce, UN
specialized agencies and other UN Organizations, non government
organizations (NGOs), educational and training institutions, and other

Chemical Abstracts
on STN Patent Update
STN have now advised that the
CA/CAplus databases now covers granted patents from:
* ARIPO (African Regional Industrial Property Organization)
* Hong Kong (Intellectual Property Department)
* Monaco (Departement des Finances et de l'Economie, Direction de
l'Expansion Economique, Division de la Propriete Intellectualle)
* New Zealand (Intellectual Property Office)
* Slovenia (Slovenian Intellectual Property Office
* Bulgaria (Patent Office of the Republic of Bulgaria)
* Estonia (Estonian Patent Office)
The coverage is retroactive to January 1, 2000.
Patents from the French Patent Office (INPI - Institut National de la
Propriete Industrielle) have been added to the list of core patent
offices covered in CA/CAplus, with bibliographic information included
in the file within 2 days of issuance and the fully indexed patent
within 27 days. The other core patent offices are the United States
Patent & Trademark Office (USPTO), the German Patent Office (GPO), the
Japanese Patent Office (JPO), the European Patent Office (EPO), the UK
Patent Office (GB), and the World Intellectual Property Organization (WIPO).

Search and Download Software
DataPros
Inc., from the US has just released a new patent search and download
software product called PatentBrowser v1.2.
"PatentBrowser v1.2, by DataPros Inc., is a robust Windows®
application, which is an intuitive and easy-to-use US Patent Search
and Download Management solution designed and developed by IP
professionals. A version to manage EPO, DEPATISnet, and JPO patents is
slated for release in August".

Australia - Patent Database Ongoing Problems
The
problems associated with the Australian New Patent Solution database
are, unfortunately, still on going. The
following points should be noted for anyone using the system. Of
course, IP
Organisers can help you with any enquiries related to Australian
patent information.
1. The Patent Aadministration
System database does not contain any
cross-reference between applications in PatAdmin
and linked applications (eg. standard
complete applications that are associated with provisionals,
additionals, divisionals) in the New
Patent Solution
database which have been filed from 5 July
2002.
2. A backlog of unprocessed national phase entry requests still
exists. This backlog is expected to be eliminated in the coming
months. However until this occurs, users should be aware that the
status of records relating to PCT
applications in the NPS database may not yet
have been updated to reflect that they have entered the national
phase.
3. Delays in receiving data from WIPO about
published AU designated
PCT applications has meant that a number of
PCT applications filed before 5 July
2002 may appear in the NPS system as new
applications. These applications only have a new format number and
hence will not be found in PatAdmin.
IP Australia is
unable to produce a definitive list of these applications.
4. Backlogs of unprocessed filed and published AU
designated PCT applications still exist and
users should be aware NPS database may not
contain PCT applications which have
designated Australia from
March 2003. Please note that the data about
PCT designations is obtained from those data tapes which
IP Australia has
received from WIPO.
5. Some patent data fields (eg. examination
request date, examination type, designation advertised date) are not
available through the online searching of the NPS
database.
6. A search of PatAdmin,
NPS and the ESPACENET databases is STILL necessary to obtain
bibliographic information about all patent applications. Failure to
search these databases may mean that a complete search has not been
conducted.

Research Disclosure Database
STN has announced
that "Research Disclosure",
the defensive publication journal published by Kenneth Mason
Publications Ltd, UK, is now available on STN as file RDISCLOSURE.
RDISCLOSURE includes descriptions of inventions from all areas of
science and technology, and is the world's longest running disclosure
service. It is also the only dedicated rapid disclosure journal
included in the PCT Minimum Documentation for patent offices around
the world. RDISCLOSURE is a full-text file and features:
- Simultaneous left and right truncation in the Basic Index
- TI and KWIC display formats for search results evaluation
- TIFF images* of the full-text article, including chemical formulae
and/or electronic diagrams
- Graphic image size (GIS) field
- Searchable publication & priority numbers in Derwent & STN formats
- Accession number field (RD serial number)
- Patent Assignee (PA) field complete with corporate, individual
inventor, and ANONYMOUS entries
RDISCLOSURE comprises 27,000 records from 1977 to March 2003, and
backfile data from 1960 onwards will be released in the near future.
More than 90% of records are in English, and the others are in various
European languages including German, French and Swedish. RDISCLOSURE
is updated monthly, and automatic current-awareness searches (SDIs)
also run monthly. RDISCLOSURE database

SAEGIS - Trademarks in Colour
The most recent enhancement to
the SAEGIS system is the inclusion of colour images for the following
registers:
* Benelux
* Community Trademarks
* Denmark
* France
* International Register
* Germany
* United Kingdom
* Spain
The enhancements allow users to view device marks in their original
filed colour. Additional enhancement now allow for improved quality of
the black & white images

Proposal To Revise The Patent System In Singapore
The
Intellectual Property Office of
Singapore (IPOS) has released information on the proposal to
revise the patent system in Singapore.
The consultation paper released seeks users views on the changes that
IPOS is proposing to the Patent System in Singapore. These comprise:
(a) Changes to the time periods for the patent search and examination
process and the
payment of patent grant fees; and
(b) Other proposals to make the current patent system more robust.

USA - USPTO Industry
Day (22 May 2003)
The United States Patent and
Trademark Office (USPTO) is holding a 21st Century Strategic Plan
"Industry Day" at their Arlington office. "The 21st Century
Strategic Plan is a roadmap guiding the transformation of the USPTO
into a quality focused, highly productive, responsive organization,
supporting a market-driven intellectual property system".
