  • IP Australia/APEC IP Education Skill-Swap Project
    Great News just announced from IP Australia. IP Australia, Using funds received from APEC under its Trade and Investment Liberalisation and Facilitation program, is managing a project to develop a public education and awareness program for Indonesia, Philippines and Vietnam. This program seeks to communicate the benefits of an effective intellectual property (IP) system for individuals and, business advantages for companies. It is great to see such regional co-operation and development in relation to Intellectual Property.

    The project is expected to be completed by the end of 2004, with the following outcomes:

    Asia-Pacific Economic Cooperation- Development of web sites for the national IP Offices,
    - Assistance with updating and reprinting an IP Q&A booklet (Indonesia only),
    - Provision of a publication for small scale industries & SMEs about IP issues,
    - Provision of a publication for Government institutions/officials about IP issues,
    - Public education and awareness training for key IP Office staff,
    - Development of a basic public education and awareness program strategy for SMEs, inventors, R&D institutes and the tertiary sector (Philippines only), and
    - Provision of a structure for IP seminars for SMEs (Philippines only)

  • Thomson - MicroPatent Merger
    In what is fast becoming a one company patent information world, news today of Thomson Corporation announcing a merger with Information Holdings Inc. (MicroPatent's parent company). As you are probably aware, Thomson already own Delphion, Derwent and many other information companies. What does this mean for competition in this market? It remains to be seen whether this growing lack of competition between patent information vendors will reduce innovation and increase costs. There is little further information from either Thomson or MicroPatent on this proposed merger. Below is the Press Release from MicroPatent, or you can read Thomson's Press Release here.

    OHIM have indicated that from 1 October 2004, the OHIM will accept international trade mark applications which designate the EC in order to obtain protection throughout the European Community, as well as applications for international protection based on a Community trade mark application or registration.   • Denmark - DKPTO English Language Services
    The Danish Patent and Trademark Office have announced a new English interface to improve the service to international users.

    "The Danish Patent and Trademark Office has made its IPR files accessible by providing an English user interface, making it possible to search Danish patents, trademarks, utility models and designs on the Internet.

    A whole variety of search terms can be used to retrieve the required information, e.g. application/registration no., applicant, application/registration date, classes, etc.

    The service is free of charge and can be accessed via the Danish Patent and Trademark Office website www.dkpto.dk/en".

  • Hong Kong - Membership of HKIPS
    "The Hong Kong Intellectual Property Society (HKIPS) was first established on 17 September 1996 under the Societies Ordinance. HKIPS was then incorporated under the Companies Ordinance on 12 April 1999. With its principal objective of promoting the awareness of intellectual property rights of the individual and a respect for the rights of others, HKIPS is probably the first and only non-governmental and non-profit making organization of its kind in Hong Kong.

    HKIPS is managed by a Council of Management comprising right owners, legislators, and personalities that are closely connected with the work of protecting intellectual property rights in Hong Kong. The Honorary Chairman is Dr Tao HO, the Chairman is The Hon. Mrs. Selina CHOW and there are five other Councillors from different professions.

    The membership of HKIPS is open to everybody, local and overseas. They can join as corporate, individual or student members. As of end December 2004, HKIPS has 160 members of all categories".

  • Europe - Annual Report 2003
    The European Patent Office (EPO) has recently released the 2003 Annual Report. It is available here to download in PDF.

    Quote from Foreward: "European patent’s geographical coverage – up from 18 countries to 28. Filings – up 104%. Staff complement – up from around 3 700 to nearly 6 000. EPO production – up 75%. Productivity – up 16%. Unit costs – down 7%. How things have changed in the European patent system and at the European Patent Office over the last eight years!   • Canada 2 - Enhancements to Search Pages
    More news from the CIPO with enhancements released to the search pages.

    "A new search page with enhanced functionality has been launched on CIPO's Web site. This page is accessible from the "Search" button on the top navigation bar and allows general searches to be directed to one of four collections: CIPO's Web site, Canadian Copyrights Database, Canadian Patents Index and the Canadian Trade-marks Database. In addition, the results page will permit clients to relaunch the search into another collection using convenient tabs".

  • Australia - Review of the Enforcement of Trade Marks
    The Advisory Council on Intellectual Property has examined issues effecting the enforcement of trade marks in Australia. ACIP has conducted a series of discussions with the business community (including both small and large businesses) in all AUstralian capital cities, and subsequently developed an issues paper. ACIP also held public seminars in Perth, Sydney and Melbourne in April 2002 to consult with stakeholders on the issues paper. ACIP received a number of written comments regarding the review. ACIP recently presented its report to the Government. The Report is available here for download.

  • World Patent Information - New Issue
    The latest issue of the international, quarterly, peer-reviewed journal, World Patent Information, has recently been published - Vol 26 No 2. The journal covers a wide range of topics relevant to industrial property information retrieval professionals.   • Europe - Reports that the EU have Abandoned single European patent
    It has been reported by the Associated Press (thanks to Steve van Dulken for the link) that Europe have abandoned plans for a "European Patent" due to language and liability issues.

    "BRUSSELS, Belgium (AP) — Done in by disputes over language and liability, European Union governments on Tuesday killed a proposal for an EU-wide patent that was a key part of their drive to make European businesses more competitive.

    Ministers from the 25 EU countries did, however, reach an initial agreement on a directive backed by big European high-tech companies that would allow software that is part of a mechanical device — such as a mobile phone — to be patented".

  • Europe - PatLib Website Launched
    The EPO has announced the launch of PatLIb.

    "PATLIB stands for PATent LIBrary. The PATLIB centres were created to provide users with local access to patent information and related issues. The centres have qualified and experienced staff who offer practical assistance on a variety of Intellectual Property Rights (IPR).

    Working in the language of the country concerned, they are familiar with the needs and requirements of local industry, agriculture and trade, and are able to provide valuable information services, especially to small and medium-sized enterprises, private inventors and academics.

    As the number of PATLIB centres has grown, the range of services has been expanded to include, for example, trade marks, designs and copyright. Many of the centres have diversified still further to provide an even greater breadth and depth of services".

  • Estonia - Annual Report from Patent Office
    The Estonian Patent Office has recently published their annual report for 2003. Unfortunately, it is not available for download but can be purchased from the Patent Office.

    "The annual report, consisting of 36 pages and having parallel texts in Estonian and English, gives an overview of the activities and achievements of the Estonian Patent Office in 2002, offering also a short forecast for the future. The report includes lists of current Estonian acts regulating the legal protection of industrial property and of international agreements binding on the Republic of Estonia as well as the contact information of the Estonian Patent Office. The annual report presents in-depth statistics about the processing of applications for legal protection of industrial property and about the corresponding state registers, thus enabling to undertake an economic analysis of the past year".

  • US - IFI Claims - US Patent Reassignments
    Current US patent reassignments in IFI CLAIMS Legal Status files is now searchable. It is available on Dialog (File 123), Questel-Orbit (CRXX) and STN (IFICLS).

    "Each weekly update of the CLAIMS Legal Status database includes all reassignment actions recorded and sent by the USPTO from the previous week. This eliminates the long wait and uncertainty of the former USPTO bimonthly updating schedule. IFI matches the assignments against the original patent assignment data in the IFI master database, identifies and filters the assignments that occur after the patent grants, and updates the assignment changes into the CLAIMS Legal Status database. The IFI reassignment record also includes the IFI standardized name for the original assignee, as well as inventor names for patents that initially issued without assignments".

  • IP News Flash - New Intellectual Property Resource
    Dr Rolf Claessen is currently studying for his patent attorney qualification. In the mean time he has developed a new website call "IP News Flash". The website automatically looks for patent and trademark related press, decisions and notices of the patent offices and other resources on the net. I have to say that this is quite an impressive effort and I think many IP Menu readers will find his site very useful

  • Philippines - IPO Closure
    The Philippines Intellectual Property Office willl be closed for business on 17-21 May 2004 to allow its officials and employees to attend the Seminar on Public Service Excellence: A Focus on TQM Core Values. The office has advised that "all documents/transactions due on these dates may be filed on 24 May 2004 and will be considered as filed on the dates they are due".

  • STN - March/April Edition
    THe STNews March/April Edition is now available online in PDF format. There is an interesting article on the history of STN which is worth the read.

    "Twenty years ago, STN’s operating organizations were already experienced in abstracting and indexing documents in their respective fields of expertise, as well as in operating online networks:
    • CAS, a division of the American Chemical Society (ACS), had launched CAS ONLINE, an online search service that is now known as the CAS family of databases on STN.
    • FIZ Karlsruhe, formed in 1977 from the merger of five older organizations in the fields of aeronautics, astronautics,
    atomic energy, mathematics, physics, and space research, ran an online network of databases, Information System Karlsruhe (INKA).
    • JST, then known as the Japan Information Center for Science and Technology (JICST), had experience operating the JICST Online Information Service (JOIS)".

  • STN - New Database - PROUSDDR
    STN has just added a new database with the less than catchy name of PROUSDDR. Despite the database name the content looks promising for patent searchers with an interest in chemistry and pharmacueticals.

    "Drug Data Report (PROUSDDR), produced by Prous Science, provides access to the latest chemical structures that are marking the future direction of medicinal chemistry and therapeutics. This includes continuously updated information on:

    More than 160,000 bioactive compounds reported in the print journal Drug Data Report from June 1988 to the present

  • Canada - Canadian Patent Database Interruption
    The CIPO has advise that we can expect interrupted Access to the Canadian Patents Database on 15 May and 16 May 2004.

    "Due to maintenance activities, the Canadian Patents Database will not be available from 7:00 p.m. on Saturday, May 15 to 10:00 a.m. on Sunday, May 16, 2004 (ET)".

  • Australia - 1 Million Trade Marks and Growing
    IP Australia has just allocated trade mark number one million to an application submitted by Western Australian based company, Anchor Foods Pty Ltd. IP Australia plan on marking the occasion by making a special commemorative presentation to the applicant. According to IP Australia, the very first registered trade mark in Australia was for "Peps", an elixir for coughs, colds and other ailments.

  • Iceland - International Registration of Designs
    "The Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs entered into force on 1 April 2004, along with common rules concerning the Geneva Act and two other international treaties in the field of industrial design, which together form the Hague-system. This means that Icelandic applicants/designers can make use of the international registration system the Geneva Act is part of. This greatly simplifies the registration process".

    Iceland is the first of the Nordic countries to accede to the Geneva Act of the Hague Agreement, and Norway is expected to join at the end of this year. Denmark and Sweden are likely to join in 2005.

  • US - USPTO Announces Version 4.11 of PAIR
    The United States Patent and Trademark Office has announced the release of the Patent Application Information Retrieval System (PAIR), Version 4.11. PAIR provides customers with direct secure Internet access to patent application status information and general patent information publicly available. There are two components of PAIR: Public and Private. Public PAIR provides status and history information for issued patents and published applications to the general public via the Internet. Private PAIR allows independent inventors, registered patent attorneys, and patent agents the ability to access real-time status of their pending patent applications. PAIR provides Internet-based access to patent application status, application documents and history information using Public Key Infrastructure (PKI) security technology.

  • Derwent World Patents Index
    Neil Larque, Customer Technical Support Strategy Manager from Thomson Scientific, has advised that itis now possible to search Derwent World Patents Index (DWPI) sections B, C and E fragmentation codes using the latest version of the codes back to the start of DWPI. These codes have been added to the pre-1981 backfile to enable searching using a single non-time-ranged strategy.

    "The addition of these new indexing paragraphs, containing the corresponding newer codes, enables searching with simpler strategies and should benefit training of new searchers.

    The codes have been added in such a way that retrieval should be as good as using a time-ranged strategy. Relevance should be as good, and for some searches will sometimes be better, than using a time-ranged strategy.

    Users who prefer to continue searching using the traditional time-ranged strategies can still do so, as no indexing paragraphs have been removed.

    The new codes are now available in DWPI on Dialog, STN and Questel.Orbit and in the Derwent Innovations Index (DII) database".

  • European Expansion Effects
    OHIM has released a neat summary of some of the changes that result from the expansion of the European Community by 10 new countries on the weekend.

    The 1st May 2004 marks the date of the 5th enlargement of the European Union. The new member states are: Czech Republic, Cyprus, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia and Slovenia. For the first time, enlargement takes place when Community trade marks and designs are in existence, with many implications for the Office.

    To ensure the unitary character of the Community trade mark (CTM) and Community design (CD) and to fully respect the pre-existing rights in the new Member States, both the Community Trade Mark Regulation (CTMR) and the Community Designs Regulation (CDR) have been amended.

    The main consequence for holders of CTMs filed before the date of accession is that their protection has been automatically extended to the territories of the new Member States since May 1, 2004.

    The extension of these existing CTM rights is automatic. No form has to be completed or fees have to be paid. More than 350,000 CTM applications and registrations will be extended and enforceable before Community trade mark courts in the new Member States as from the date of accession.

    The same automatic extension applies to some 33,000 Registered Community Designs. Holders of registered and unregistered Community Designs will equally benefit from the automatic extension of their rights, and they will be able to enforce them before the Community Design courts to be established in the new Member States.

    Since 1st May 2004, applications can be filed at OHIM in any of the 20 official languages, for example, Hungarian. The OHIM will translate the application into the remaining 19 languages for publication. Since applications filed in any of the new languages have to be examined with regards to possible grounds for refusal in those languages as well, the OHIM has already started to recruit staff from the new Member States. The Office currently counts on more than 20 colleagues covering practically all new nationalities, and recruitment procedures will go on.

  • Hong Kong - New Forms
    The Intellectual Property Department of Hong Kong has announced that from 7 May 2004, the Trade Marks, Patents and Designs Registries will replace all the existing forms with the new specified forms. Some of the new forms include:

    P4 - Request to record a designated patent application for a standard patent under sections 15, 16, 22 of the Ordinance and sections 8, 18 of the Patents (General) Rules Request to record a designated patent application for a standard patent under section 7 of the Patents (Transitional Arrangements) Rules
    P5 - Request for registration of a designated patent and grant of a standard patent under section 23 of the Ordinance and section 19 of the Patents (General) Rules Request for registration of a designated patent and grant of a standard patent under section 7 of the Patents (Transitional Arrangements) Rules
    P6 - Request for grant of a short-term patent under sections 113, 116, 125 of the Ordinance and sections 58, 74 of the Patents (General) Rules
    P10 - Request for renewal of a standard or short-term patent
