PatSee PRO Upgrade to Version 4
PatSee PRO is
software that allows users to download complete copies of patent
specifications. Image Applications has now announced an upgrade to
PatSee PRO which will now be able to find A1/A2 etc documents from Esp@cenet
even if the user enters the wrong suffix. PatSee PRO is now able to
download almost all patents hosted on Esp@cenet and will be able to
get overseas equivalent when specified patent not found. To find out

Romania accedes to the European Patent Convention
On
12 December 2002, the Government of the Republic of Romania (RO)
deposited its instrument of accession to the European Patent
Convention (EPC) and to the Act revising the EPC of 29 November 2000.
The EPC will accordingly enter into force for Romania on
1 March 2003.
The European Patent Organisation will thus comprise the following 27
member states as from 1 March 2003: Austria, Belgium, Bulgaria,
Cyprus, the Czech Republic, Denmark, Estonia, Finland, France,
Germany, Greece, Hungary, Ireland, Italy, Liechtenstein, Luxembourg,
Monaco, the Netherlands, Portugal, Romania, Slovakia, Slovenia, Spain,
Sweden, Switzerland, Turkey and the United Kingdom.

Matters
An

website - "Patenting in the biopharmaceutical industry - comparing the
US with Europe". The article is by Luke
Foster, Doina Nanu and Simon Alcock of Derwent.
"Patents play a key role in the
biopharmaceutical industry. Although there are significant differences
between the laws governing biopharmaceutical patents in the US and in
Europe, over the past decade the number of biopharmaceutical filings
and granted patents has risen substantially, on both sides of the

ICANN Board Approves Plans
for New TLDs
The board of The Internet
Corporation for Assigned Names and Numbers (ICANN) approved plans to
add a limited number of sponsored Top-Level Domains (TLDs) on 15
December 2002 at its 2002 Annual Meeting in Amsterdam. Sponsored
domains (such as the existing ".museum" and ".coop") are created for
specific community groups and registration in the new sponsored TLDs
will be restricted. The precise number and names of the new sponsored
TLDs is yet to be determined and ICANN have indicated that this will
be resolved in early 2003.

Property On The Internet - Report
The World Intellectual Property
Organization (WIPO) has released a publication which reviews impact
that digital technologies - the Internet in particular - have had on
intellectual property (IP) and the international IP system. The report
("Intellectual Property on the Internet: A Survey of Issues,") is
available for download from the WIPO website

is "designed as an overview for all those interested in gaining a
perspective on how intellectual property has been affected by digital
technologies, and the pivotal role played by the IP system itself in

New Zealand - Trade Marks Act 2002 Now Available
The Trade Marks Act 2002 has
now received Royal Assent. As a result the sections of the Act
containing regulation making powers and powers to establish a Maori
advisory committee have now come into force. It is anticipated that
regulations will be made and a Maori advisory committee will be in
place within 6 to 9 months. The rest of the Act will be brought into

Software - PatentIn 3.2 Released
The United States Patent and
Trademark Office (USPTO) has announced the release of anan enhanced
version of PatentIn 3.1, naturally called PatentIn 3.2.
PatentIn 3.2 contains additional features designed to ease
the authoring of sequence listings. PatentIn 3.2 is also certified
for Windows XP.
Features of PatentIn 3.2
- PatentIn 3.2 offers customers features designed to
lessen the time required to prepare patent applications containing
nucleic acid and amino acid sequences. These features include:
Ability To Create Default Explanations -
PatentIn 3.2 provides default explanations for “n”s and “Xaa”s in
sequence listings. Default explanations are labeled as miscellaneous
features containing the location of the variable characters, and the
message, “n is a, c, g or t” for DNA sequences, “n is a, c, g or u”
for RNA sequences or “Xaa can be any naturally occurring amino acid”
for protein sequences.
Customers also have the option to create definitions for variables.
Ability to Apply Comments to All Sequences -
PatentIn 3.2 allows customers to apply a comment for one
artificial or unknown organism to all other sequences in the project
with “artificial” or “unknown” as the organism.
Return of the Character Filter
PatentIn 3.2 permits the customers to import text files of sequences
that contain characters other than nucleotide or amino acid symbols
such as spaces and numbers. This benefit was previously offered in
PatentIn 2.x.

Delphion Research from
the privately-held Delphion Inc. for a

- Canada - CIPO Granted International Searching & Examining Authority Status
The Canadian Intellectual Property Office has been granted status as an International Searching Authority (ISA) and International Preliminary Examining Authority
(IPEA) under the Patent Cooperation Treaty administered by the World Intellectual Property Organization
(WIPO). The status was approved by members of the Patent Cooperation Treaty Union on 27 September 27 2002 at the annual meeting of member states of
WIPO. The proposed start of ISA/IPEA services will be in the (Northern Hemisphere) summer of 2004. The Canadian Intellectual Property Office
(CIPO) has announced that they will now begin training staff and setting up the putting in place the administrative processes required.

- US - Will Paper Get a Reprieve?
The United States Patent and Trademark Office has announced its decision to withdraw its 24 July Certified Report to the US Congress on the removal of patent and trademark paper files from its public search rooms. The USPTO made the following statement in their recent USPTO News:
"The decision does not represent a conclusion by the agency that the removal of the paper files will negatively impact the public. It does allow the USPTO to reexamine some details of the paper removal plan in light of specific issues that have surfaced during current litigation".

- STOP PRESS - Australia - High Court Decision on Publication on the Internet
In a case that potentially has implications beyond defamation law in Australia, the highest court in Australia (High Court of Australia) has dismissed an appeal by Dow Jones & Company Inc in
the matter of Dow Jones & Company Inc v Gutnick - [2002] HCA 56 - 10 December 2002.
The High Court of Australia unanimously dismissed Dow Jones' (the international news service) appeal to
have a defamation action brought by mining magnate Joseph Gutnick heard in the United States
(instead of Victoria, Australia). This significant judgment means that material that is published on the internet is deemed to have been published in the place it is viewed online, not the country of origin

"If it were accepted, publishers would be free to manipulate the uploading and location of data so as to insulate themselves from liability in Australia or elsewhere: for example, by using a web server in a "defamation free jurisdiction" or, one in which the defamation laws are tilted decidedly towards

"Choice of law in defamation proceedings in this country raises a relatively simple question of identifying the place of publication as the place of comprehension: a readily ascertainable
fact".........
"There is another relevant consideration. The law of defamation has some elements in common with the law of injurious falsehood, copyright and contempt. With respect to the last, as Windeyer J in Australian Consolidated Press Ltd v Morgan pointed out, "[t]he power [of punishing for contempt] has been not infrequently exercised in Australia in a salutary way against newspaper companies for publishing matter calculated to prejudice the fair trial of pending proceedings." It would be anomalous if an international publisher might be liable for contempt in this country but not in defamation".

- Community Designs Applications From 1 April 2003
On 18 November 2002, the Administrative Board of the Office for Harmonization in the Internal Market set the date for filing applications for registered Community designs at the Office as 1 April 2003. - Comparable Study on Patentability Issues of 3D Protein Structures
The Patent Offices of the US, Europe and Japan have published results of a comparable study on patentability issues of 3D protein structures which provide some guidance in filing protein-related patent applications.
"The Department of Commerce’s United States Patent and Trademark Office (USPTO) today announced the publication of a report, published in association with the European Patent Office and Japan Patent Office, that provides clear guidance for filing in each of the three offices patent applications relating to three-dimensional protein structures. The guidance provided by this study will help Americans who file for patent protection on their proteomics based inventions both here and abroad comply with the patentability requirements of each office,” noted James E. Rogan, Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark

- Questel-Orbit - New Patent Family Searching Feature
Questel-Orbit have released a new enhancement to their QWEB interface which allow a user to directly request a Family Search.
A user can enter a patent number, priority number or application number together with their userid and password. Upon hitting enter, you automatically log into
Questel, access the Pluspat database, conduct the family search, display the results and log the user out of
Questel. The results of the search are displayed in Family summary table, with linked bibliographic and Legal Status details. A use feature for those of us who like to further process the data is that you can exported the results to a RTF or HTML file.
I used the feature this morning before posting this item and I can say I was pleased with the speed, ease of use and layout of data.

- MicroPatent - New Patent Index Database
(MPI)
MicroPatent has announced the launch of its new Patent Index Database
(MPI), which is a combination of patent data from the European Patent Office
(EPO) and proprietary MicroPatent content and features.
Micropatent
News states the following: "MPI is the most timely, complete bibliographic database in the world.
MicroPatent combines DOC.db and INPADOC (which may have 2 - 3 weeks of lag time) with its own data collections, so you have the latest front-page data available. Additionally, MPI is configured in a logical, easy-to-use manner so you can quickly and easily access relevant data – and, you’ll save
money over abstracting and indexing databases, as MPI is a less-expensive alternative".
Here are specific facts and features about MPI. It contains:
• The European Patent Office’s (EPO’s) INPADOC database, which combines family data
(IFD) and legal status (PRS), plus the DOC.db collection, the EPO's examiner database.
• Citation data from the EPO, USPTO, & PCT.
• Bibliographic data from 72 countries/patent authorities.
• Legal status information for 42 countries.
• Records date back to 1920 or earlier (Germany to 1877).
• Foreign characters have been mapped to English for searching.
• Front-page updates are pulled from other MicroPatent data sources to fill in gaps where abstracts are missing from INPADOC and
DOC.db.
• Drawings are available for US, EP, PCT, and JP records.
• US Class updates are done six times annually.

- Canada - Supreme Court Says No to Patent on Genetically-Modified Mouse
(Oncomouse)
The Canadian Supreme Court in a 5-4 judgment has said that the mouse does not qualify as an invention under the federal Patent Act of 1869. The
"oncomouse" was patented in Austria, Belgium, Denmark, Finland, France, Germany, Greece, Ireland, Italy, Luxembourg, The Netherlands, Portugal, Spain, Sweden and the United Kingdom.
"A higher life form is not patentable because it is not a "manufacture" or "composition of matter" within the meaning of "invention" in s. 2 of the Patent Act".

- USA - USPTO To Begin Electronic Processing of Patent Applications
The U.S. Department of Commerce’s United States Patent and Trademark Office
(USPTO) this week
began a test at replacing its standard paper processing of patent applications with electronic processing.
"The prototype will include front-end administrative processing of selected new applications, as well as processing and examination of pending applications in three art units that handle biotech and semi-conductor inventions. The paper documents in the application files assigned to the prototype will be scanned into electronic image files including the specification; oath or declaration; drawings; information disclosure statements; amendments; examiner decisions; and file jacket notations. Processing and examination of these applications will then be performed with the electronic files by the examiners, technical support staff and all other USPTO professional staff during the

- Hong Kong - Trial Access to Trade Marks Database
The Hong Kong Intellectual Property Department's database of trade mark records is now available online in a "trial" format. What that means is that it is intended for "trial use and testing only". The data records viewable in this version do not represent the full details currently on the Register and should not be taken as authoritative. Generally the database contains records of registered trade marks and trade mark applications pending before the Trade Marks Registry, except those registrations which have had the "Removed" status for over one year, and those applications which have had the "Application Withdrawn" status for over two years. Historical details of trade mark registrations are not currently available on-line. To find out more, click

- Domain Names - Dialog Adds Searchable Database of Internet Domain Names
Dialog has just announced the launch of a searchable database of more than 65 million current and historic Internet domain name records. The database includes records for about 20 million currently active domain names, with most containing detailed
"Whois" information.
"Unlike the simple domain name look-up services available on the open Web, Dialog subscribers may search from more than 50 indexed Whois data fields contained in domain registrations, including the registrant's name, corporate affiliation, address, phone number and specific technical information such as IP addresses".

- Chemcial Abstracts Service - 50% of New Chemical Substances Disclosed First in Patents
An interesting press release from Chemical Abstract Service today regarding new chemical substances. The Chemical Abstracts Service
(CAS), reported that more than 50 percent of the organic and inorganic chemical substances recorded in the CAS Chemical Registry System during 2002 were derived from patent
documents as opposed to journal literature and other publications.
"This finding highlights a trend evident since at least 1998 in which an increasing percentage of substances of this type have been reported for the first time in

AlphaPatent, the Israel firm that provides
"AlphaPatent Downloader" (which provides patent documents from the US, EP, PCT, JP and other countries via email or viewed as a single web page) has introduced a new product called "Deposit Account Monitoring Service". The Deposit Account Monitor software automatically checks a user's USPTO deposit accounts throughout each work day and emails the user an account statement each time the user's account balance changes. - IP-Discover - New Patent Search and Download Software
 I have just discovered a new piece of software which will greatly appeal to IP Menu readers. It is called "IP-Discover" and it provides an integrate interface for search both USPTO and esp@cenet database. I have just downloaded the lite version and was very pleased with the interface and functions. There is a professional version available for
USD$125.00 with additional feature (although at this stage I am not sure what they are). Best of all, if your a "amateur" or "student" the lite version is free!

- Slovenia & Hungary Join EPO
 The European Patent Organisation
(EPO) has announced (2 December 2002) that it will have two new member states. Both Slovenia and Hungary have ratified the European Patent Convention
(EPC) and will become contracting states in December 2002 and January 2003, respectively. It will now be possible to file European patent applications for those countries and have them granted by the European Patent Office. This takes the EPO up to 26 member states.

- Congratulations - Phillips Ormonde & Fitzpatrick Gains Two New Attorneys
A bit of a pat on the back to

Fitzpatrick, who with IP Organisers bring you
IP Menu. Congratulations to two of professionals, Jeff Holman and Ian
Horak, who have successfully completed the course that will make them our newest Australian and New Zealand Patent and Trademark Attorneys.
 Jeff
Holman graduated with a first class honours degree in chemistry in 1989 and a PhD in Organic Chemistry in 1993. He then carried out research on labeling and clearance studies of a non-steroidal anti-inflammatory drug in the pharmacy department of an Adelaide hospital.
Jeff moved to the United States to conduct research at the Cancer Research Institute at Arizona State University. His research involved the synthesis and studies of antineoplastic cyclic peptides. Jeff then returned to the Research School of Chemistry at the Australian National University where he carried out research into steroid synthesis and alkaloid synthesis. Following this, Jeff returned to Adelaide University where he conducted research on antisense oligonucleotide synthesis and was also involved in other independent research.
Jeff joined an Adelaide firm of patent and trade mark attorneys in 1997, he was registered as a trade marks attorney in 2000 and joined Phillips Ormonde & Fitzpatrick in 2001.
Jeff's research has been published in a number of scientific publications and he has been awarded the Rennie Prize by the Royal Australian Chemical Institute and the George Murray Grant by Adelaide University. Jeff is a chartered chemist, a member of the Royal Australian Chemical Institute and the American Chemical Society.

Ian Horak studied at Monash University in Melbourne, graduating with a first class honours degree in Engineering in 1996 and with a Bachelor of Laws Degree in 1998. He was admitted to practice before the Supreme Court of Victoria in November 1998.
Shortly after his admission, Ian joined the firm as an Information Researcher with the Information Services Department, focussing primarily on searching patent literature databases and legal research for the firm's professional staff. Ian's experience with computer and Internet technology led to his current role in the firm within the Electronics, Physics and Information Technology group.
Ian's major area of practice is in the provision of Intellectual Property advice for IT companies. He has experience in drafting patent applications dealing with a wide variety of Internet and business method inventions.
Ian is a member of both the Victorian and Transnational Committees of the Intellectual Property Society of Australia and New Zealand
(IPSANZ). He is also a member of the Institute of Patent and Trade Mark Attorneys of Australia
(IPTA) and the Victorian Society for Computers and the Law (VSCL).

- USA - IFI Claims Legal Status File Updated
The IFI CLAIMS Patent Services has announced that they have updated their CLAIMS Legal
Status file with the latest reassignment information. "Of more than 31,000 patents affected by reassignment recordings in the most recent update, over 20,000 patent numbers are appearing in the CLAIMS Legal Status file for the first time. The reassignments are now current through
October 7, 2002".

- WIPO Summit on Intellectual Property and The Knowledge Economy
WIPO has announced the WIPO Summit on Intellectual Property and The Knowledge Economy which will be held in Beijing from 24 to 26 April 2003.
"The World Intellectual Property Organization (WIPO) is honored to announce that the Government of the People’s Republic of China will host the WIPO Summit on Intellectual Property and the Knowledge Economy in Beijing, from April 24 to 26, 2003.
Participating Heads of State and Heads of Government will gather in the Great Hall of the People on the morning of April 24 for the opening ceremony of this high-level, high-profile event, in the company of senior government officials, leading CEOs and high-level industry policy-makers. They will be welcomed by the Chinese leadership and the Director General of WIPO to the start of three days of discussion, reflection and comment on issues ranging from mining intellectual resources to exploiting the power of cyberspace and making the IP world safe for both users and beneficiaries. The Summit will culminate on April 26 with the closing ceremony and celebration of World Intellectual Property
Day".

PIUG, Inc., The International Society for Patent Information has announced details of the 2003 Brian Stockdale Memorial Award. BACKGROUND:
This award is dedicated to the memory of Dr. Brian Stockdale who travelled
extensively throughout the world imparting his knowledge of patent searching.
Brian's career encompassed positions with Derwent, SmithKline Beecham, and
Technology and Patent Research International. As Brian was so well known
internationally and trained many patent information professionals, his work was
highly regarded. Brian always relished each new search as a challenge and loved
working with the people in this industry. Brian is dearly remembered by his
friends and colleagues most of all for his dry wit, keen intellect, and ease of
meeting people and socializing wherever he went. As one of the world's most
talented patent information search professionals, he is sorely missed. This is
our tribute to his personal dedication in training colleagues, particularly
those new to the field of chemical patent searching.
AWARD PACKAGE:
The award covers standard travel expenses and conference registration fees to
assist the award recipient in attending one PIUG Annual Meeting, An
International Conference for Patent Information Professionals, up to an amount
not exceeding $1500. This award is generously underwritten by Derwent and also
by Technology and Patent Research International.
AWARD SELECTION PROCESS:
The award recipient will be new to the patent information profession, with less
than 3 years total work experience. Alternately, the recipient will be a student
currently enrolled in a college or university with a demonstrated interest in
pursing a career in patents, preferably a career in patent information.
Potential candidates must submit a short essay, not to exceed 500 words,
describing their professional or educational interests, as well as their need
for financial assistance with respect to conference attendance. Submissions must
include the candidate's name, mailing address, phone number, fax number and
email address as well as a description of his or her patent information
experience and current employer/university name and address.
Essays must be sent to simmons.es@pg.com.com on or before January 15, 2003. The
award recipient will be notified on or before March 1, 2003. The award recipient
will be recognized during the PIUG annual meeting. The PIUG 2003 annual meeting
will be held at the Holiday Inn Chicago Mart Plaza, in Chicago, Illinois, USA on
May 3-9, 2003.

- United Kingdom - CIPA Educational Review
The Chartered Institute of Patent Agents
(CIPA) have just (26 November 2002) released a report by
Professor Avrom Sherr and Richard Harding entitled "Where science meets law" - a Report of a Review of the Education, Training and Examinations for the Chartered Institute of Patent Agents and the Institute of Trade Mark Attorneys. The report is available for

- GetPat
& GetPat Pro - New Software For Patent Searching - Now
Released
In the past 2 months IP Menu
has been trailing the pre-release version of Alberto Manservigi
GetPat Pro patent searching software. Alberto has now
announced the release of the software. A trial version is
available for download. One
note for those interested in this software, as the software is
Java based it is important that you follow the download
instructions carefully.
Essentially, if you know how to use esp@cenet
then you can easily use GetPat Pro. The fields available to
be searched are the same as esp@cenet.
In fact the system is actually interrogating the esp@cenet
database. You have the option of entering your query
in the normal field format (see below) or, in the Pro version, you
can create more complex queries. Once the search has been
executed, the software then proceeds to download the esp@cenet
records, all fields including abstracts. This may take some
time depending on the size of the results set, but once completed
you can scroll through the records at your leisure using the built
in interface. We found this a useful feature as we
were able to run the query and then download the records in the
background.
Those records which you think are worth
investigating further can be selected and added to a separate
list. Once this separate, filtered list is compiled, you can
then download parts of the patent or the entire specification
with one click. One of the best features of this software is
the ability it has to identify whether the patent document is
actually available on the esp@cenet
servers for download. If not, it offers you a list of
family equivalents which are available.

Then before you download carefully
read the "How
to Install" instructions. The trial version will
operate in full 10 times before requiring registration. The
standard version GetPat is USD$500 and the pro version, GetPat Pro
is USD$700.00.

As noted on the European Patent Office website, the PATLIB Conference website is now available.

Centres. The PATLIB Conference is organised within the framework of the EPO's co-operation policy with the National Patent Offices of member states.
PATLIB2003 will be held in Palais des Congrès, Liège -a picturesque town in the province of
Wallonie- in east Belgium from 21 to 23 May 2003. The central theme during last year's Conference was "A New Epoch Begins". Now that the new epoch has indeed begun the PATLIB community takes on the challenge it has brought. Therefore, this year's Conference theme is "INVESTING IN THE FUTURE" referring to training".

- New Zealand - Trade Marks Bill Passed
According to the Intellectual Property Office of New
Zealand (IPONZ), the The New Zealand Trade Marks Bill had its third and final reading in the house on Friday 22 November 2002. Once the Bill receives Royal Assent, the regulation-making powers and powers for the Commissioner to establish a Maori advisory committee will come into force. It is expected that this phase will take place within 6 to 9 months.

- Intellectual Property Symposium 2002 - Mainland - HK and Macau SARs
The Hong Kong Intellectual Property Department is organising the Symposium in collaboration with the (China) State Intellectual Property Office and the Macao SAR Economic Services, with assistance and support of the Guangdong Provincial Intellectual Property Office. - Hong Kong - New Trade Mark Ordinance Seminar
The new Hong Kong Trade Marks Ordinance is expected to come into force in January 2003. In anticipation of the launch of the new Trade Marks law, two half-day briefing sessions (one in Cantonese and one in English) have been organized which we focus on the features, procedures and transitional arrangement, forms and on-line searching.
