Japan - Trends in Industrial Property Right Applications and
Registrations
The Technology Research
Division of the Japan Patent Office has just published a web paper on
"Trends in Industrial Property Right Applications and Registrations"
[available here]. The report provides some interesting information and
trends such as:
"The number of patent applications in 2002 in
Japan was 421,044, down 4.7% from the preceding year and practically
unchanged from 2001. (The peak was 439,175 in 2001.)"

"The number of applications to the Japanese Patent Office (domestic
applications + applications by foreigners) accounted for 5.1% of the
total number of applications worldwide (9,750,000), the highest share
of any country. Nevertheless, the JPO's share has been declining each

offices have sharply increased, especially PCT applications to
multiple patent offices"

Pennie &
Edmonds To Close
It
has now been confirmed that one of the USA's leading Intellectual
Property firms is to closes its doors on 31 December 2003. Pennie &
Edmonds will cease on that date with many of the partners and staff
moving to the general practice firm "Jones Day" where they will set up
an IP arm. It is also reported that the partners and some staff from
the Palo ALto office of Pennie & Edmonds will join "Morgan Lewis".
Newswires have also reported that David Weild and Maria Scungio (two
trade mark partners) are joining "Fross Zelnick Lehrman & Zissu". Here

meaning!!!

PCT at 1 January 2004
There will be a number of
changes to the Patent Cooperation Treaty (PCT) that will come into
force on 1 January 2004. Including on relating to designations:
"The change to the PCT legislation means that
all countries bound by the PCT, at the time of lodgement of the PCT
application, will be designated. There is a provision for deselection
of the designations of Germany, Japan, Republic of Korea and the
Russian Federation. This has been provided due to the national law in
these countries stating that if a priority application is made in that
country and the subsequent PCT application designates that country
then the priority application is deemed withdrawn".

The CIPO have produced a hart
outlining the availability of Canadian patent documents thare are now
available. For those people who regularly use the CIPO service, this
chart provides helpful indications of the expected delays for the
delivery of these documents.

- The USPTO Proposes Rectrification Practice for Attorneys and Agents
Just announced from the United States
Patent and Trademark Office (USPTO) is the proposal that requires
mandatory periodic continuing education for everyone registered to
practice before the agency. As with most jurisdictions around the
world, the USPTO currently requires that attorneys and agents pass an
initial examinations before registering to practice. The proposal will
give practitioners the choice of getting recertified through an
interactive on-line examination on USPTO’s Web site or as part of a
USPTO pre-approved private course taken to satisfy a state bar
continuing legal education requirement.
“Quality plays a central role in all elements of
the USPTO’s 21st Century Strategic Plan,” noted USPTO Director James
E. Rogan . “Practitioners well-versed in USPTO’s rules and patent law
tend to file better quality patent applications than those who aren’t.
Higher quality applications result in higher quality patents because
examiners can focus on core examination issues such as determining if
the invention is novel, rather than on paperwork the applicant failed

Canada - Reduced Fees for Some On-line Services
You may be aware that the Canadian
Intellectual Property Office (CIPO) offers a variety of on-line
services. CIPO have advised that from 1 January 2004, fees associated
with some of these services will be lower than fees associated with
other methods of filing. The CIPO is also reminding users that
"technical reasons" sometimes mean that such services can not be
always available. "Clients are responsible for ensuring that deadlines
are respected even in cases where the performance of the Web site is
affected or on-line services are unavailable". Read more

Japan - Intellectual
Property Cooperation in The Asia-Pacific Region
A new
report published on the Japanese Patent of website deals with
intellectual property cooperation in the Asia-Pacific region.

"All over the world, R&D and business activities
are becoming increasingly global and borderless, and the securing of
worldwide Intellectual Property(IP) protection is becoming an
extremely important issue. IP protection is a key factor for promoting
foreign investment and technology transfer, as well as for boosting a
nation’s industrial development. It will also bring considerable
economic benefits to Asia-Pacific nations. Since developing countries
became obliged to implement the WTO/TRIPS Agreement* on January 1,
2000, legal systems for IP protection have been enhanced worldwide. In
order to protect Intellectual Property Rights(IPRs) adequately, it is
important not only to set up an appropriate legal system, but also to
upgrade IPR system practices.
The JPO considers it critical to ensure an adequate IPR protection
system for economic growth of the region. It therefore extends
cooperation in areas such as human resource development,
computerization and information processing at IP offices, as well as
in examinations and searches, including provision of examination
results particularly to Asia-Pacific countries through various schemes
such as the Japan International Cooperation Agency (JICA) program and

Australia - Trade Marks - Version 6 of ATMOSS Released
Some good news to report from
IP Australia for a change. The latest release of ATMOSS (Version 6) is
now available. There has been some great improvements in useability
with the ability to customise your search/results screen to a muck
larger degree. Some of the changes include:
Screen Settings - ATMOSS6 has been
designed to work best with a screen resolution of 1024 by 768.
Navigation Panel - The introduction of
the navigation pane on the left hand side of the screen, reducing need
to scroll.
Customisation - The amount to which you
can customise your use of ATMOSS has been extended in the latest
version. The major change is the ability to customise the search
results page. You can choose to display owner name information in your
search results. This is particularly useful if you are performing an
owner name search. You can also choose how many search results to
display per page. Displaying Status (Low Level) will display the exact
status rather than the broad groupings of pending, registered, never
registered, etc.

United Kingdom - Patent Enforcement Project
The UK Patent
Office has posted a notice inviting tenders from
"suitably qualified people" to undertake a scoping study for a
Patent Enforcement Project.
According to the notice, "this proposed scoping
study has evolved out the initial concept of a ‘Patent Defence Union’
which was formulated by Professor Kingston. Professor Kingston’s
report was produced for the European Commission in 2000 and is
accessible from

The stated objective of the UK Patent Office study is to "develop
the concept of a PEP to the level of detail necessary to inform future
funding decisions".

In news just in, Secretary of
Commerce and Director of the United States Patent and Trademark Office
James E. Rogan has just announced his resignation effective 9 January
2004. It is reported that he is leaving the agency to finish work on
his autobiography, "Rough Edges" which will be published by
Harper-Collins this summer.

Hong Kong - Second
Level .hk Domain Names
The IP scene has been very active in
Hong Kong recently and this time it is in relation to Domain Names and
Trade Marks. Hong Kong Domain Name Registration Company Ltd known as
HKDNR has announved the launch of the new Second-Level '.hk' domain
name commencing in January 2004.
"The new 2LD refers to a shorter domain name
category (eg 'yourname.hk') as compared to the existing 3rd level
categories (eg 'yourname.com.hk'). The new product launch will begin
with a 6-week Priority Registration Period starting from January 5,
2004 to February 13, 2004. During the period, local and overseas
holders of Hong Kong trademarks or service marks that are registered
with the Trade Mark Registry under the Intellectual Property
Department (IPD) of the Government of HKSAR can apply for 2LD with an
exact match with their corresponding marks".

USPTO - Revision of Patent Term Extension and Patent Term Adjustment
Provisions
The
patent term extension provisions of the Uruguay Round Agreements Act (URAA)
and the patent term adjustment provisions of the American Inventors
Protection Act of 1999 (AIPA) each provide for the possibility of
patent term extension or adjustment if the issuance of the patent was
delayed due to review by the Board of Patent Appeals and Interferences
(BPAI) or by a Federal court and the patent was issued pursuant to or
under a decision in the review reversing an adverse determination of
patentability. The United States Patent and Trademark Office (Office)
is proposing to revise the rules of practice in patent cases to
indicate that under certain circumstances a remand by the Board of
Patent Appeals and Interferences shall be considered a decision in the
review reversing an adverse determination of patentability for
purposes of patent term extension or patent term adjustment.
Written comments must be received on or before 5 January 2004. For

Province and Macao - Intellectual Property Database
To help
enterprises deal with intellectual property regimes in Guangdong
Province, Hong Kong and Macao SAR, a number of government departments,
including, Guangdong Provincial Intellectual Property Office,
Guangdong Provincial Administration for Industry and Commerce,
Administration of Press and Publication (Copyright Bureau) of
Guangdong Province, Intellectual Property Department of Hong Kong SAR
and Intellectual Property Department of the Macao SAR Economic
Services have jointly developed the "Intellectual Property Database
for Guangdong Province, Hong Kong and Macao SAR". This Database is
designed to assist "investors to search in a
one-stop-shop manner for information on intellectual property systems
throughout the region".
"The Database covers online information sources
on intellectual property systems in Guangdong Province, Hong Kong and
Macao. Users can search for information including legislation,
registration system and related government bodies in different
intellectual property issues such as copyright, trade mark, patent and

Canada - Trade Marks Journal Online
The CIPO has announced that the
Canadian Trade Marks Journal is now available online in two separate
sections. Apparently many CIPO clients reported problems when
downloading or printing the Trade Marks Journal due to it's size. The
CIPO now have the option to download the Journal in two parts.

IP-Discover - New 2004 Release
IP Menu's favorite patent
search and download program would have to be IP-Discover. Keith Nagel
from IP-Discover has just announced the release of the 2004A release,
and it is has some significant improvements. The new 2004A release of
IP-Discover fully supports the release version of Espacenet, solving
many of the complaints users have about printing and concatenation
using the new Espacenet system.
New features include
1) Resizable and dockable controls. Make full
use of your large CRT.
2) IE style Address Bar with pulldown history of documents viewed.
3) Download all document components to root directory, or separate
folders.
4) Copy function for collecting all document types from subfolders.
5) Annotation Bar to annotate documents.

Keith tells me that there is a pirce increase from 1 January 2004
however if purchase now you can beat the price rise. Keith has done a

Abstracts from ISI Web of Science Now Free on Delphion
Another recent
development
from Delphion is the linking to the abstracts of scientific journal
articles published by Thomson ISI. From the "Other References" section
on a Delphion Integrated View, you can click an ISI Abstract link to
go directly to the ISI Web of Science. This gives you free access to
the article abstract.
Delphion states that if you are a Web of Science subscriber, you will
also see all of the other features and value-added information to
which you subscribe. One downside is that if you are not a subscriber
there appears to be no information on how to subscribe or purchase the
article.

US - Plans to Cease Supply of Cited Art
The
USPTO has just posted a notice of a plant to stop supplying copies
of cited US patent references with office actions. They have also
announced a pilot program to asses alternatives.
"The United States Patent and Trademark Office
(Office or USPTO) plans in the near future to: (1) cease mailing
copies of U.S. patents and U.S. patent application publications (US
patent references) with Office actions except for citations made
during the international stage of an international application under
the Patent Cooperation Treaty and those ma de during reexamination
proceedings; and (2) provide electronic access to, with convenient
downloading capability of, the US patent references cited in an Office
action via the Office's private Patent Application Information

Questel-Orbit Adopts Lingway Language Processing Technology
Whilst it
is not quite clear what this new technology will do in respect of
Questel-Orbit's full text patent files, it is always worth reporting
advances relating to patent databases.
"With the emergence of full text files, powerful
search engines are a first step when trying to meet user needs. Beyond
the retrieval of relevant documents, it is essential to speed up the
reading process of documents that can include tens if not hundreds of
pages. In this respect the Lingway Patent Suite (LPS), which combines
linguistics, XML and viewing technologies, allows quick display of key
information embedded in full text such as the major advantages of an
invention, drawbacks of former patents, cited individuals or corporate
organizations as well as potentially independent claims. The
technology will initially be made available on US, European and PCT
patent documents and then will be extended to French and German
Patents".

The Australian Advisory Council on Intellectual Property (ACIP) is an
independent body appointed by the Australian Federal Government to
advise the Minister for Industry, Tourism and Resources on a range of
intellectual property (IP) matters. ACIP also provides strategic
options and advisory support for

Trade Marks - Madrid & the Community

On 27 October 2003, the Council adopted the necessary legislative
measures to establish a link between the European Community trade mark
and the Madrid Protocol. These measures consist of
- a Council Decision approving the accession of
the European Community to the Protocol Relating to the Madrid
Agreement Concerning the International Registration of Marks, adopted
at Madrid on 27 June 1989, and
- a Council Regulation modifying Council Regulation (EC) No 40/94 of
20 December 1993 on the Community trade mark to give effect to the
accession of the European Community to the Protocol Relating to the
Madrid Agreement Concerning the International Registration of Marks
adopted at Madrid on 27 June 1989.

STN International Launches New
French and British patent databases
STN have just
announced two new patent databases, FRFULL and GBFULL to be available
on STN in 2004. "The new reference database
FRANCEPAT contains abstracts of patent applications and patents
published by the Institut National de la Propriété Industrielle (INPI),
France, since 1966. The new databases FRFULL and GBFULL to be launched
on STN in 2004 will provide full-texts of French and British patent
documents".

New USPTO HQ Opens 2 December 2003
The new United States Patent and
Trademark Office headquarters in Alexandria, Virginia will be opened
on 2 December 2003.
"This new state-of-the-art facility supports
many of our strategic goals including the transition to e-government
and, most importantly, the need to attract and retain a highly skilled
workforce,” noted Under Secretary of Commerce for Intellectual
Property James E. Rogan. “The new headquarters will do that by
providing a safe and enhanced quality of life environment for those

One of the main characteristics of the WIPS search system is WIPS’ own
patent family information made possible by the Distributed Information
Linkage System (DILS). The purpose of DILS is to record patent

Canada - Call for Comments on Proposals for Self-Regulation of Patent
& Trade-mark Agents
Industry Canada is seeking
views on certain proposals that have been made by the Intellectual
Property Institute of Canada to grant privilege to and establish
self-regulation for Canadian patent and trade-mark agents.
"The discussion paper includes a series of
outstanding questions for the purpose of obtaining effective feedback
from interested parties with a view to developing policy options".

On-line Filing of Patent Applications
The UK Patent Office in
collaboration with the European Patent Office has developed an on-line
filing facility for patent applications on the EPO’s epoline® system.
"The system supports the secure on-line filing
of UK national, Patent Cooperation Treaty [PCT] national phase and
European Patent Convention [EPC] (both directly to the EPO and via the
UKPO as a national office). In the near future, the system will also
support the filing of PCT international applications at the UKPO as a
receiving office and PCT applications directly to the International
Bureau as a receiving office. The EPO is also progressively developing
on-line filing modules for other national offices".

IP Australia - Delays Due to
"System Issues".
IP Australia have advised that due to
a number of "system issues" there is a backlog of unexamined
examination requests. Yet another problem that has resulted from the
expensive upgrade of the computer systems at IP Australia. If you are
wondering what happened to your application, read on.
"Since July 2002, all new patent applications
and any associated exam requests have been located in e-case files
within the new PAMS system. Due to a number of system issues,
currently, there is a backlog of unexamined exam requests in PAMS
dating back to July 2002. Patent examination staff are steadily
working through this backlog to bring it within IP Australia's
customer service charter target of a first report issuing within 9
months of the filing of a request for examination. Thus, IP Australia
would suggest that there is no need for you to inquire about the
status of these exam requests particularly where those inquiries are
automatically generated by your IT systems. This message is intended
to be a general response to existing inquiries on these applications".

International Patent Information
Award - Nominations Closing Soon
The ‘International
Patent Information Award’ or ‘IPI-Award’ was established in 2000 and
has been presented on an annual basis since then.
"The Award is aimed at recognizing individual
contributions towards the advancement of patent information and
related disciplines, and to the patent information world in general.
Users of patent information and producers of patent information are
equally eligible to be nominated for the Award".
Nomination letters for the IPI-Award 2004 are now being accepted
however the deadline is 19 December 2003. The announcement will be in
"Spring 2004" [One presumes they mean the northern hemisphere
"spring"!!!!!!]. Nominations should describe the nominee’s
contribution to the field of patent information, and each letter
should include any material in support of the nomination.

Supplementary Protection Certificates for Medicinal Products
On
17 November 2003 a Decree on Supplementary Protection Certificates for
Medicinal Products in Slovenia was published.
"This Decree defines the procedure for the
acquisition of a supplementary protection certificate for medicinal
products. Any product protected by a patent in the territory of the
Republic of Slovenia and
subject, prior to being placed on the market as a medicinal product,
to the administrative authorization procedure as laid down in the
Medicinal Products and Medical Devices Act may, under the terms and
conditions provided for in this Decree, be the subject of a
certificate".

Warning - European Institute for Economy & Commerce(EIEC)
The UK Patent Office (amongst
others) have issued another warning on the questionable practice of a
company called European Institute for Economy & Commerce(EIEC), based
in Brussels. This company offers its services to applicants who have
applied for a trade mark. They usually invite payment of a fee to put
the trade mark application on some register.
Other companies involved in similar practices have been identified
before, namely:
- Institut of Commerce, Trade and Commerce,
based in Switzerland.
- ZDR-Datenregister GmbH, based in Frankfurt.
- COMPANY FOR PUBLICATIONS AND INFORMATION ANSTALT (CPI), based in
Liechtenstein.
This is a timely reminder to applicants that if they receive advice or
an invoice for your application from anyone other than your trade mark
attorney, you should contact your attorney, or if you receive an
unwanted direct mail about your trade mark, you should contact your
local Patent and Trade Mark Office.
