PatBase - New searchable Patent Family Database from Minesoft and RWS
Group
Minesoft

database which covers over 28 million patent families worldwide for
current and retrospective searching. Called PatBase, it provides fast
search and access to English language titles and abstracts, patent

- Europe - Two Presidents for the EPO
It has been report that the EPO has elected two presidents for the EPO,
Alain Pompidou and Alison Brimelow. Apparantly the administrative
council elected Pompidou (French government member) and Brimelow
(chief executive office of the UK Patent Office), to split the
presidency of the EPO between them. Pompidou will take over from
outgoing president Ingo Kober on July 1 2004 and stay in the post
until June 30 2007. Brimelow has been appointed president from July 1
2007 to June 30 2010.

Australia - The Mess
That is IP Australia's Patent Database System Continues........
To no ones surprise but
everyone's continued disappointment and frustration, IP Australia has
issued yet another new "warning" on using their online databases.
Reproduced below.
New Warning
IP Australia has identified an inconsistency in APPS resulting from
different IPC mark formats used in our old and new systems.
The data on APPS is correctly loaded from the APA CD each week.
Unfortunately however, Patadmin IPC marks are loaded with a format of
B63B049/00 while NPS IPC marks are loaded with a format of B63B 049/00
(additional space).
While we work on putting all IPC marks into the former format (no
additional space), customers will need to search for both IPC mark
formats to ensure they are getting full search results

INPADOC - New Canadian Legal Status Information
The EPO has
advised in their latest newsletter advice that the Canadian Industrial
Property Office (CIPO/OPIC) has started to supply the EPO with its
administrative legal data. Backlog data to 1982 is also being supplied
and is being loaded in batches.
The information supplied comprises:
1) the Canadian patent number
2) the date of the official notification (‘PRS date’)
3) the legal status code ( 4 positions)
4) the effective date of the event

PIUG - Membership Renewal
Ken Koubek from PIUG (the Patent
Information Users Group) would like to remind everyone on the PIUG
list that the drive for 2004 membership has begun!

PIUG Memberships expire on 31 December each year and must be renewed
to retain member status. The membership is currently at around 600
from 22 countries. Membership is USD 35.00. It is probably the best
$35 you will spend this year in relation to your intellectual property
work. I am a little biased because I have been a member for many years
and have found that PIUG is one of the most active, helpful and
interesting groups for IP professionals. If you are already a member,
please remember to renew. If you are not a member, please consider
joining this group.
As a Full Member or Associate Member you will

* The PIUG Newsletter, a semi-annual publication containing member
articles, search tips, information on patent database vendor and

UK - International Classification for Industrial Designs
On 21 October 2003, the United
Kingdom became party to the ‘Locarno Agreement Establishing an
International Classification for Industrial Designs’.
This agreement establishes a union of states using an international
system for classifying goods in which industrial designs may be
incorporated. This requires that contracting states must apply the
relevant classifications to designs protected under their national
design registration laws.
The UK Patent Office has been operating under the requirements of the
Locarn Agreement for several years so you will not expect to see any
changes in practice at the office, however it does mean that the UK
Patent Office can now take part in the regular discussions that go on
relating to amending the classification system.

Open Patent Services, or how raw data can be
served pre-cooked
Open Patent Services (OPS) represents a new way of accessing patent
information via the internet. Unlike the esp@cenet® service, which
offers data via a "rich" HTML interface, OPS is a Web services
application offering the same data in XML format for building custom
applications based on the raw data behind today's HTML-based patent
databases.
Europe's industry needs patent information more
than it realises
The majority of industry in Europe does not use patent information, or
is not even aware that it exists. While this may seem a somewhat
disappointing finding, it does at least give an idea of the enormity
of the untapped market for patent information, and sends a very clear
message to those on the supply side: there is plenty of work to do.

GetIPDL -
New Version 2.7.1 Now Available
GetIPDL
have released another update to their Patent Downloading software.
Version 2.x is a Shareware program,
however there is a freeware versions with certain
limitations. These limiations are removed when you register the
product. The cost is US$89.00 to get the
registered version. It should be noted that the tracking or statistic
feature which concerned many users is now removed in the licenced
version.
In this update the changes include:
- Adding patent numbers from the context menu of
Internet Explorer is supported.
- Downloading US design patent from EPO server and DEPATIS server is
supported.

Europe - EPO Release Report on "Profiles of Patent Information"
The EPO have just released a
report on the main results of the survey "Usage Profiles Of Patent
Information Among Current And Potential Users" which was commissioned
by the European Patent Office.
"The subject-matter of this study is patent
information. We are aware of previous surveys concerned with
innovation, the use of the patent system and the commercial value of
patents. However we are not aware of any previous survey on this scale
which deals exclusively with the subject of patent information.This
survey was carried out in an attempt to identify the usage profile of
patent information amongst current users. Another aim was to try and
contact non-users to discover what it is exactly, that prevents them
from using patent information, and what could be done to encourage
them to use patent information in the future. The survey was also
intended to determine whether “advanced“ applications of patent
information exist or should be developed, in addition to the
“traditional“ uses of patent information. The overriding philosophy in
carrying out the study was to give the user a voice in determining the
future of the patent information business".

Delphion - Derwent Enhancement on Delphion
Delphion have recently made an
important improvement to their Delphion/Derwent services. Now, data
from the original patent and INPADOC have been integrated with Derwent
value-added data. Delphion now provides the original title, claims and
INPADOC legal status displayed directly on the Derwent Record.
Similiarly, searching Delphion's other worldwide collections, you can
now choose to display the more meaningful and descriptive Derwent
Title in your Result Set. Very welcome improvements!

Questel-Orbit - Legal Status
File Reload
The Legal Status file (LGST) on
Questel-Orbit has been reloaded to "reflect the
streamlining of coverage by the EPO".
Questel-Orbit have advised that the reload removes coverage of status
actions that do not impact the legal standing of the patent. This
means more than 550 out of 3000 actions have been deleted.

WIPO - Namibia Accedes to WIPO's Patent Cooperation Treaty
Namibia
became the 123rd Contracting State of the Patent Cooperation Treaty
(PCT) when it deposited its instrument of accession at WIPO on October
1, 2003. The Treaty will enter into force for Namibia on January 1,
2004. The accession by Namibia means that in any international
application filed on or after January 1, 2004, applicants may
designate Namibia (country code: NA) and also that nationals and
residents of Namibia may themselves file PCT applications as of that
date. As Namibia will be bound by Chapter II of the Treaty, it may
also be elected for the purposes of international preliminary
examination.

US Patent Maintenance Fee Status Data Available
PatentValuePredictor now posts U.S.
patent maintenance fee status data on its web site. The patent
maintenance fee status data is available for free, however you do need
to register (free) to access it.
In order to check the maintenance fee status (enforceable,
unenforceable) of a patent on www.PatentValuePredictor.com, search the
"Patent Valuations" database. Once you enter a patent number, the
database will return the patent number, the title, and the
enforceability status information for that patent.
Rick Neifeld of PatentValuePredictor reminds us that
"U.S. patent maintenance fees are due 3.5, 7.5,
and 11.5 years after issuance of a U.S. patent. Failure to pay the
maintenance fees results in the patent being unenforceable. That is,
the maintenance fee status for that patent is then "unenforceable."

PatentValuePredictor periodically obtain patent
maintenance fee status data from the USPTO and update their
PatentValuePredictor patent database with that data. The date of the
most recent patent maintenance fee status data released by the USPTO
that has been loaded into the PatentValuePredictor database is noted
on www.PatentValuePredictor.com as the "Last Patent Enforceability
Data Update." Currently, this date is "August, 2003".
Great to see someone making it a little bit easier to find our US
patent status information!

Australia Decisions Complete to 1903
Austlii
has announced that the complete digital set of the High Court's
decisions from 1903-47 is now available on the High Court of Australia
database on AustLII, making it now among the few complete free access
online national courts databases of any country, back to the first
decision of the Court. The database has been released to coincide with
and celebrate the Court's centenary. The database is available
here.

Canada - Enhancements to the Canadian Copyrights Database
The CIPO has announced some
major enhancements to the Canadian Copyrights Database. These include
the optimization of the search capability, additional result list
display options and, most significantly, the linkage between the
detail pages and the grant of interest detail pages.
Principal changes are:

Searching
1. The company name is no longer a separate searchable field.
An author or an owner/assignee search will now find all names, both
company and non-company.
2. The application number has been removed from the result list and
the detail pages. This is an internal processing number and was not
useful for external clients.
3. Searches may now be conducted by registration number or by
registration date which are of interest to our external clients.
Search Result List
1. There are more choices for the content and display of the
result list allowing you to sort results by relevance, registration
date (ascending and descending), author's name (ascending and
descending) or owner's name (ascending and descending).
2. In addition, you can return greater numbers of documents (100, 200,
500, 1000, 2000 or 5000) per search and choose the number of documents
displayed per page (10, 20, 50, 100 or 200).
3. The client's search query is now displayed on this list. Printed
results can be reviewed at a later time in the appropriate context.
4. In addition to the title, the result list now contains the
registration number, the document type (Copyright, Other Subject
matter and Grant of Interest) the author(s), the owner(s)/assignee(s)
and the registration date. This allows clients to better identify the
document(s) they need.
Detail Page
One of the most significant enhancements is the linkage between
the copyright work detail page and any grant of interest records.
Clients may view the detail page for the work and then link directly
to the detail page of the grant of interest related to that work.

WIPSGLOBAL - A New Approach to
Patent Database Searching
It is not often we think of
Korea when we think of patent information database suppliers, however
a relatively new player in the area is WIPS Co., Ltd. They have been
providing worldwide patent database for domestic clients since 1999
via www.wips.co.kr and in May this year started an English-based
service www.wipsglobal.com .
Their database coverage includes US, EP, JP, WO, INPADOC, KR(KPA),
JP(PAJ), and CN patent data. You can trial their system using Userid=guest
and password=guest. It is a well thought out service and the ability
to include KR and CN data is a plus.
WIPSGLOBAL claims several advantages compared to other patent
information providers.

"Firstly, in the aspect of data coverage, we
have perfect database for Korea and Japan patent compared to other
providers, Even though clients have to use KPA, PAJ Data for searching
because of language barrier, after searching, they can see the full
patent document of the searched patent directly (downloading and
printing are available). And also for English-based data(US, EP, WO,
INPADOC, PAJ), there is no weakness in the aspects of data update
time, coverage or data reliability compared to other providers such as
Micropatent, Delphion, Dialog, etc.
Secondly, WIPSGLOBAL provides more reliable and up-to-date patent
family information. Generally, other provider uses INPADOC data for
patent family information. However, as you know, INPADOC provides just
a certain part of each country's data and also data update is quite
slow because of the delay of data transmitting from each country's
patent office. To overcome this shortage of INPADOC, WIPSGLOBAL data
are connected and interlinked each other. Therefore, a patent
application No. and priority No. can be matched. It means you can find
the most recent family patent information from each country's patent
data directly.
Thirdly, there are several useful supplementary functions. WIPSGLOBAL
is not just for patent database. WIPSGLOBAL provides visual and
text-based citation analysis for US patent, Cabinet function (searched
patent management tool), Clustering function, and much more other
functions for maximizing the
efficiency of search work.
Fourthly, the automatic linkage of relevant patent data is available.
Usually, a certain patent has a close relation to other patents such
as patent family, cited patent, etc. In WIPSGLOBAL, a user can move to
directly to any relevant patent information just by clicking the
hyperlinked patent
number. This causes the dramatic reduction of search working time".
WIPSGLOBAL is certainly a well thought out and designed system. It is
always great to see competition in this area and I'd encourage all
patent information users to visit WIPSGLOBAL and at least try the
"guest" access.

USA - Documents in Trademark Disputes Can Now Be Accessed Online
Today, the Trademark Trial and
Appeal Board (TTAB) of the U.S. Department of Commerce’s United States
Patent and Trademark Office (USPTO) unveiled TTABVue, a system that
allows users to view images of documents relating to trademark
disputes on the Internet. TTABVue includes images of most documents
filed since January 2003. Some earlier records covering the period
June 2001 to January 2003 also are available.

New Zealand - New Online Journal
The New
Zealand Patent Office (IPONZ) Journal is currently produced in PDF
format and is made available on CD-Rom, at an annual subscription.
Alternatively it can be downloaded free of charge from the IPONZ
website.
During the pilot Journals published after number 1492 (publication
date 31 October 2003) are available via this facility. It is possible
to search Journals published prior to 1492. However, the information
provided may not be complete.
IPONZ have now released a pilot version of the online journal
(patents, trade marks and designs) and this can be viewed

and Trilateral Offices Agree to Reinforce Ties
The World Intellectual Property
Organization (WIPO) and the Trilateral Offices - the European Patent
Office (EPO), the Japan Patent Office (JPO), and the U.S. Patent and
Trademark Office (USPTO) - have
agreed to reinforce collaboration to ensure delivery of more
efficient services to users and to promote the benefits of the patent
system. "At a meeting in Geneva on the sidelines
of the annual WIPO Assemblies on September 25, 2003 with EPO
President, Mr. Ingo Kober, JPO Commissioner, Mr. Yasuo Imai, and US
Deputy Under-Secretary of Commerce for Intellectual Property and
Deputy Director of the USPTO, Mr. Jon Dudas, WIPO Director General,
Dr. Kamil Idris, stressed the need to move ahead with international
efforts to promote reform of the patent system to ensure easier access

Dubious and Misleading Fee Requests
The
UK Patent Office has once again highlighted the dubious and misleading
practice of several companies which "offer" services with requests for
fees.
"They are mailing applicants whose patent or
trade mark applications have been published in the bulletins of the
European Patent Office (EPO), World Intellectual Property Organisation
(WIPO) or the Community Trade Mark Office (OHIM). They usually invite
payment of a fee to put the patent or trade mark application on some
register. These registers have no connection with the UK Patent
Office, and have no legal significance.
Three companies that have been doing this are:
- Institut of Commerce, Trade and Commerce, based in Switzerland.

Australia - More Badly Applied Band-Aid Solutions
Lapsed PCT
Applications Listing - IP Australia has advised today that PCT
applications designating Australia which have lapsed because they have
not entered the national phase within 31 months of their priority
dates are being listed in a "Lapsed
PCT Applications Listing". This is a list of PCT publication
numbers in a rich text format (rtf) document. Users have been without
this important information for over 12 months now. It amazes me
that given the enormous budget and expertises available to IP
Australia that they could not incorporate this very important
information into the NPS patent database. Now users have to consult
yet another data set of information to conduct simple enquiries!
The problems with NPS are now well over 12 months old
and they are not getting any better. Australia once had a excellent
system, but not anymore. I don't know of one professional user who
isn't mourning the loss.
